I don't know what it was about the Israeli company that bought the copyright, but I have a suspician that they overplayed their hand, and it got to a point where IH would rather have set fire to his channel than pay them. If only IH had the correct political opinions such as those of Hasan Piker, then Hbomberguy might have been able to overlook it all.

have not completed whole video, but from what I gather there's no mention of any of the various channels that just grab green-text posts from 4chan or reddit comments from certain subs (D&D, pro-revenge, etc.) and provide audio narration. They're not outright plagiarism in that they often show the original post in the background or shoutout the name of the user account that posted it (or the post number if it came from one of the chans), but to the extent those videos are transformative, it's significantly less so than the IH video in question. Maybe those channels get permission from every single poster they include in their video so there's absolutely no risk of getting hit with a copyright claim, but I doubt that all of them do.

Or, more likely, IH realized that trying to fight a corporate entity with far more money and resources than he could ever dream of wasn't worth it. Mental Floss is owned by Minute Media who have a nine-figure annual revenue and hundreds of people. They also have an R&D center in Israel. Mmm.

While Mental Floss was, I guess, legally right to file the DMCA, as flawed and abused as that law is, I still have to LOL at their audacity. They, along with other scummy clickbait sites like Outbrain, Mindly, etc, are responsible for the glut of clickbait titles and pages spread like shit all over the internet, with a stupid headline like "You won't believe what happened with XXXX celebrity!!!", or a nothingburger story spread out over 30+ ad-riddled pages or Q&As lifted directly from pReddit with no attribution, or maybe in 2pt font at the bottom of the page after all of the ads have already loaded. For a thief to whine about thievery (as debatable as it is when the source is a single 5+ year old article in the first place) is peak irony.

I run a fairly small youtube chamnel as a hobby and make about $1000 per 100,000 views. longer videos pay out even better, and high sub accounts also get better cuts on CPM and clickthrough. Ad reads can get up to like $10K per minute for Raid Shadow Legends, and no doubt you gain more negotiating power as your sub count rises.

Every youtuber is a horrible liar about how much they make to grift their audience, and I don't doubt IH and HBG have made ridiculous amounts of money off this.

My point (that I probably didn't get across very well, or at all, long work days will do that to you) is that I don't see the outright insistence on "hundreds of thousands of dollars" as necessarily accurate. And even if it were so, if there were a theoretical LOL-suit between MF and IH, then any damages paid out by IH would only be on actual youtube ad revenue, Patreon, in-video sponsorships and other income streams likely wouldn't be looked into for damage assessments. As a side note, out of curiosity, what type of YouTube content do you make? I'm not asking for you to doxxxxxx yourself, just curious about the content genre in general.

I didn't even watch it since just his face pisses me off and 20 minutes, much less 4 hours, is a big fucking ask of me. I talk about media I like, all kinda really, anything that interests me, movies, books, games. I have a few videos that have a fairly high view count, but only a few thousand subs. It's notable that revenue is absolutely inflated by subcount and other factors- big channels get better cuts, my numbers are pretty much the minimum you would make off of X views. Hundreds of thousands would be implausible, but certainly 10s of thousands per drop would be likely, not that you'll hear about it from youtubers since it's inconvenient for the grift.

That is not fair use. You are right that fair use requires consideration of multiple criteria, but "illustrative purposes" is not one of them. If it were, news reporters/paparazzi/journalistic photographers would not exist because why would anyone pay them? You could just rip off the footage of the [news story] from someone else. This is not like even something up for debate. The courts routinely hear copyright cases like this all the time. Just displaying a video to demonstrate something or give an example of someone is not fair use.

Do people just steal videos for demonstration purposes anyways? Yes. Large corporations have learned that suing small YouTubers for using a clip of your movie is REALLY bad PR. Plus, memes and trends are more powerful advertising tools than they could possibly reclaim in money. Whoever filmed that video of Becky is not making any money from this video essay, and no exposure from the discussions that come from this video are benefiting them in any way.

The point of my comment was that this fucking dweeb says repeatedly "People plagiarize because they don't respect the people they're stealing from". I am pointing out that he is doing the exact thing he criticizes in the video. He is stealing video from someone because he does not believe videography is a medium deserving of not being stolen. According to Social Blade, IH has only lost about 40k subscribers which is about 1% of his subscriber base. If anything getting rid of the most histrionic part of his fan base is probably doing him a favor.

He stole from the person who did the leg work to film that video, and then he used it without their permission and left it in uncredited. If the copyright owner of that video took him to court today and said "your honor, this man stole my video", he would win.

No BreadTuber actually writes letters to copyright owners to use their content. None. It takes forever to get a response, for one, and two, they usually will refuse your request. Everyone on YouTube, from movie reactors to BreadTubers to people making parodies of songs, DO NOT own the rights to the original copyright. Do you think all those people reacting to Game of Thrones wrote letters to HBO asking permission to use their content? No. Do you think BreadTubers like Philosophy Tube writes letters to those academics he cites to get access to their copyright? No. Do you think YTP makers need to ask Viacom or other cartoon media companies to use their work? No.

Most likely case to me is that the original crediting missing was an oversight, since the moment that it was reuploaded with a more differentiated script, there is no need to credit anymore yet it was added. I'm also convinced they very much prefered to not give a fucking penny to Mental Floss and keep it in house by paying his budies and team to do some extra takes. The original author never came into the equation which is why I think Mental Floss are the current owners of the story. Could they have reached to the original author? Yes definitely, is there any legal need? No, if I understand right, all discussions would stop with Mental Floss from a legal standpoint and I imagine the IH only cared about that angle.

Sorting "new" comments on his latest video and 50-60% of the comments are still about the plagiarism. Is it actually disappointed fans or reddit raiding? I'd guess more the latter. New video is at 5% dislikes where he is usually in the 1-2% range.

Doesn't YouTube treat dislikes as engagement with a video and give it more traction in the algorithm? There's obvious reason for them to do this if only to discourage review bombing content, but from their perspective they don't care if people like or hate something as long as they engage and keep watching and clicking on videos.
