Welp, looks like Deni is out of luck.
Checking the rules for K1 Visa applications. Of course, Ralph is still legally married so thereās one rule broken but heās going to eventually be divorced so thatāll be out of the way. This one wonāt, though.
- The U.S. citizen sponsor must meet the income requirements for a K-1 visa, namely the adjusted gross income on their most recent tax return must equal to at least 100% of the Federal Poverty Guidelines. They may use a joint sponsor if they are not able to meet the income requirement on their own.
First off, Ethan Ralph filed financial info to the Court in Rochester NY pleading poverty in order to get a free lawyer.
Second, the folks at the US Embassy/Consulate are going to want to see recent tax returns proving income. Ralph hasnāt filed taxes in many years and is avoiding doing so because of the money he would owe, penalties accrued, legal repercussions for not filing.
So thereās absolutely no way for Ethan Ralph to bring Deni to the US and marry her. Heād have to have his divorce/custody case with Meigh finalized, explain why he was poor enough to require a public defender in that case yet somehow has enough income to qualify at the time of the Visa application AND clear his trouble with the IRS beforehand and bring in recent tax returns to to US Embassy at time of application proving sufficient income.
