It is my opinion that if Nick wins on appeal, Judge will still dismiss his special motion to dismiss, for reasons laid out here:
I don't think a state should be forced to apply law that it has found unconstitutional in its courts, and I didn't find Randazza's argument trying to distinguish between the statutes very convincing. I think they're similar enough.
 
It’s great that Nick immediately found a high priced attorney that he’d already insulted one of the partners of the firm.

This always slips my mind, but on the plus side, I get a good laugh every time I'm reminded. Everything you need to know about Nick's pride, vanity, legal knowledge, social skills and affinity to wasting of money is demonstrated by this 1 line.
 
FYI all, Sean aka Potentially Criminal is doing a mystery stream tomorrow at 11am EST ... Which is 10am CST. Only posting this here in case he got permission to stream the court for the balldo appeal, which is coincidentally at that time.

Seriously, imagine spending all this fucking money and wasting an appeals courts time over esoteric questions of Jurisdiction that won't even resolve the underlying case. When all you gotta do is admit Monty is not a pedophile and pay some compensation.

Take the fucking L rackets.
What’s the ball park estimate for compensation to Monty if Rackets was to squash this now and admit he defamed Monty?
 
Is it unusual for an Ohio lawyer anybody to get a Minnesota court to allow a hearing to be streamed?
I wouldn't say it's typical. Going over the caseload for the week, a lot of dry and/or esoteric sounding cases are on the docket. Flip side, there were people streaming the Derek Chauvin appeal. So it's not unprecedented but also not a regular occurrence.

In an hour and a half, the Oral argument starts. Within 24 hours, a copy of the argument hearing will be found here. Within 90 days, the Appellate Court is required by law to issue its judgement on the matter.

Remember when Sean didn't want to donate to Nick's fundraising attempt because he was concerned that he might somehow be called to act as a witness in the case or some such?

I thought then, as I think now. Sean's no fool. If Rekieta wants to spunk his money on a retarded law suit, he's more than welcome to do so -- but he should be spunking his own money on the case.

I hope Sean makes a million dollars in Superchats.
