Josh did a dev diary on 9chan, he was trying out image recognition software that would automatically ban CP. He was testing it on images of actual cheese pizza (the food, not a euphemism) and getting decent results. The problem was the main hashed databases for CP are run by NGOs that refuse to let you query them without a loicense, and they won't give access to small guys, only big "legitimate" platforms like Twitter and FB. So an image board would have to have heavy manual moderation.

It quickly became apparent that the 8chan loli guys were determined to ruin anything Josh touched, so he had to give up 9chan. (The namefags he mentioned in that post were the splinter /vg/ loli posters, who demanded their own reserved board and got butthurt about the containment rules.) Anyone who claims Josh allowed or encouraged CP is straight up wrong.

I always figured that this was the reason for Randazza taking the case (besides money). If he can establish this precedent, it will make his lawyering in the future much easier.

Jurisdiction arguments are nightmarishly complex, but they all generally boil down to "where did the Injury(civil) or Crime(criminal) occur?" In the case of Defamation, this is usually where the defamed person lives.

I don't know if this was caught, but the co-counsel with Randazza in court today is Matt Kezhaya. He's the Minnesota attorney sponsoring Marc to appear pro hac vice before the court in Minnesota. It may be a requirement he has to babysit in person for every appearance Marc makes... which will also be very, very expensive.

Edit to add: this is not a surprise, Matt has been on the paperwork (once Balldoman got representation), but it's another interesting wrinkle in the money pit this trial is probably proving to be for Balldoman.

Edit: Also, local counsel is supposed to generally check your work and babysit you through the process. It's still not a huge expense because (1) you don't have to fly them in, and (2) they are just checking, not doing the actual drafting.
