If he wins the case just goes back to the trial judge in Minnesota. The same one that said it was already defamation per se. She would then apply Colorado’s anti-SLAPP law to the case. She could still find Monty’s case wasn’t frivolous and therefore not SLAPP it down.

I noticed that the people reacting to my theory as dumb are basically new to the thread or not a regular that I've seen in this thread and I would bet that they are not even aware of even half of what has been posted in this thread lol. When I posted it the last time I think the reactions were quite different since iirc at the time I only saw regular posters.
