They are fucked in so many other ways that having to defend a defamation suit would finish them. They're probably still doomed, but at least the final nail won't be hammered into the coffin by nool.

Before anyone goes "So why did Jersh need all this money", the fact Null got that much money was why Epik kneeled. Also magnamity in victory. It serves no purpose to kick a surrendered foe. We have way too many other foes to deal with as is.

Tbh I'm glad it went this way because it is better to have a war chest for what may be a much more clear-cut and easy to win case later than to have it basically lockboxed to guarantee getting a defamation case across the finish line.

One of the big features of the establishment and one of the reasons why they are so entrenched is their utter refusal to take an L under any circumstances, there not being a hill too small to die on, and their willingness to escalate things to the furthest possible extent that they can go without caring how much they could potentially lose. So long as they win in the end.

They aren't really the establishment. They're a company facing litigation risks civil and even possibly criminal, with debts they can't pay, and really can't afford this one too, especially looking down the barrel of a lawsuit funded by a six figure war chest in the hands of an absolute madman who isn't afraid to use it.
