No. They are not. The loophole stake.us lives in is the exact reason they are not gambling losses, but any withdreaws are taxable income.

Personally I think the sweepstakes loophole is a very thin fig leaf for what is obviously just a plain old gambling site. If it is an actual loophole, I expect it to be closed, but the DoJ may get riled up enough to go after them anyway, and from their previous statements, they probably would not consider this a legitimate sweepstakes, but an illegal gambling site. The vast majority of activity is just straight up gambling. The daily dollar is virtually insignificant, and it is not like they're selling a product, even a ridiculous one like gacha mystery boxes and you can mail in to get a "free" ticket.

It is functionally identical to any other online gambling that was banned from bank transactions under the UIGEA.

Caveat: it hasn't been prosecuted yet despite operating openly, and just because the DoJ talks some shit that doesn't make it the law, and when they ignore someone operating openly doing shit they've said is illegal and they DON'T prosecute it, it says they're not terribly confident about their own opinion.

Sweepstakes are a form of gambling. These are the same. Again, if you are worried about the federal government not getting enough, you're welcome to cut them a check. Until then, the taxpayer is allowed to arrange their tax burden to be as light, or non-existent, as they can possibly arrange it.

The first sentence here is correct, although it's generally a legal form of gambling. The last sentence is also correct. Tax avoidance is completely legal. It's tax evasion, filing false returns, whatever, that is illegal. However, who here do you think gives a fuck whether the IRS sucks enough blood?

I'm pretty sure everyone here given the choice between paying federal taxes or juicing the Bossman would pick the latter.
