I remember this point being a big reason WOTC changed course in as much as they did last year with the abrupt changes they tried to make to the Dungeons&Dragons license. A few 3rd-party creators decided to just start their own Open Source equivalent using the D&D ruleset when WOTC announced their intentions to lock shit down. WOTC said "hey you can't do that" and then their lawyers said "well ackshually yes they can."
