I don’t think it’s as simple as that. Bromwich is definitely of the Labor persuasion, but I don’t know if he’s that personally progressive. Anyway this case is not about what the law should be. It is at its core a case about what the Federal Government has power to enact. A secondary issue is even if the Government has the constitutional power to add gender identity, or it can be brought into the Act through wizardry, whether the SDA can even operate with an expanded definition of man or woman, given it was based on biological reality.
