Depends entirely on what court they are being prosecuted in. In state court, the state age of consent controls. In federal court, the federal age of consent controls. But the feds are extremely picky about what cases they take, and there needs to be a use of interstate commerce to trigger fed jurisdiction (any use of the capital-I-Internet or a cell phone is usually sufficient). The vast majority of prosecutions of perverts take place in state court, unfortunately, as the feds have hefty sentencing guidelines and federal inmates can't just get paroled out a couple months into their sentance, which is sadly common in state penitentiaries.

What this map misses out is that most of those European AOC laws also include caveats about the age gap below a certain age.

In France, it's 5 years maximum if you're below... 20, I think, but they're considering reducing it. That means a 21 year old with a 15 year-old is statutory rape, regardless of whether the 15 year-old claims to consent. The age of consent is also conditional on the broader relationship of the participants. If the older party has any sort of power or control over the younger, age of consent rises to 18.

The low age of consent exists because kids are fucking one another anyway and shouldn't be getting criminal records for statutory rape just because they're young and stupid. It's definitely not an excuse for adults to start a jailbait harem, or whatever is the current weird fantasy of the terminally online.
