No, its pretty solid. Improper handling of evidence is one of the few things that will outright taint your case. The FBI fucking around with the documents and not putting them back in the boxes exactly as they were before is bad enough, but what's worse is they've pretended for months that everything inside the boxes is exactly as it was when they were taken from Mar-al-Lago. Discovery is the one, single phase of a trial you do not fuck with, and the Feds have been caught red-handed fucking with it, and worse, lying about fucking with it. Lying to judges is guaranteed to piss them the hell off, and hoo boy has Jack Smith done that here on top of the legal issues inherent to the evidentiary mishandling. You'll notice that a lot of the Jan. 6 stuff has been getting a much more skeptical eye by courts ever since the videos came out where it was obvious the Feds had been lying to everyone about how bad it was, and that's not just because of the PR.@John.Doe I am not a lawyer. On top of that the stuff with lawyers is also beyond terrible since Smith is arguing that its no big deal that they'll be out of state four days of the week with a different trial, and representation in court is the other major red flag, with cases like Gideon mandating effective counsel for defendants in criminal trials, with Trump's team arguing that with this and the NY stuff they'll be too split attention-wise to provide effective counsel to his Florida criminal trial.
Thank you both for confirming my own conclusions. I felt hesitant to believe my own here because this seems like far too massive a fuckup. This does support my earlier speculating that this was Garland going rogue though. The higher ups of the three letter agencies are nowhere near amateur enough to not have had proper oversight on something this big and unprecedented. The only way something this big of a fuckup could occur is if oversight was being handled by people without any real experience in covert legal fuckery.The Florida documents case is beyond fucked. In the investigation, discovery, case presentation - at every stage really - taking care of the evidence is paramount. You need two-factor chain of custody, preservation, documentation, all kinds of steps to make sure that the evidence is kept sacrosanct to the degree humanly possible. (If you don't have chain of custody on that blood sample, how do you know it was from the scene, etc.) In this case, the government has admitted two things:
1) They purposefully moved the evidence around in order to garner publicity shots or for other purposes, then failed to return the evidence as it was prior. (Imagine the State troopers moving a post car-collision corpse for more dramatic crime scene photos). Even this is pretty bad, almost bad enough by itself to torpedo a case.
2) They misrepresented to the Court about doing this. As in, they tried to claim that they hadn't moved anything, and everything was exactly as they found it, which is a lie. Here's some trivia for you - judges hate it when you lie to their faces about presenting manipulated evidence to them.
Now, in a DC courtroom where the judge is a political terrorist who doesn't give a shit about the law, this isn't a problem. Unfortunately for the DOJ, they are dealing with Judge Cannon, an actually neutral party seeking to give the parties due process. So her response to this, on top of the other shenanigans Jack Smith has pulled, is to shut the party down.
She hasn't dismissed this case yet, but I think she will after she builds a bullet-proof case that the 11th Circuit can't overturn with a semblance of good faith. Telling Smith that he isn't getting a court date until they settle the half-dozen or more dispositive (case-ending) issues is, I think, her signalling that somewhere in there is the death warrant for this case. She just wants to document very thoroughly, develop the brief, and assemble something definitive.
That is the best read I can get from her paper orders and the briefs, you'd need to sit me in the courtroom to see her face and voice for more, but every indication I've gotten so far is that she is running out of patience with Smith.
