It really depends how hard the prosecutor wants to go after it, and whether there's anything questionable about how they obtained the evidence they'd need to use. If there's some exclusionary rule thing conceivably he could get off scot-free or at least plead the drug thing to some diversionary program. That's assuming the much more serious gun charges are in there to coerce a plea to the relatively minor possession charge, and that the prosecution isn't going to be a real hard charger on it. It's entirely possible the prosecutor hates his guts and has had to deal with this asshole personally and is gunning for him.

So it sounds like a lot regarding his punishment is dependent on how badly the prosecutor wants to make a deal out of this - just my opinion, but given the situation involves a house with many kids living in that environment, I'd hope for a guy that wants to make that into the point. While completely different state, I'd love to see a guy like the state prosecutor in the Michelle Troconis case that Sean streamed - that guy was a complete dick and made it very well known how much he didn't like the defendant, but hey, she was guilty on all charges.

If I had to guess, I'd say they were giving Kayla a chance to sort out her child care before they took her down to the station. When it's white cops arresting white middle class folks, they'll often do you this kind of favour. It makes it easier on them as well. Instead of dragging a shedload of kids down to the station or hanging around at Rekieta's house while somebody from CPS is contacted and they arrange some kind of temporary foster care for the kids, they'd just let Kayla call her family and wait until they showed up, or possibly even put her and her kids into a couple of cars and drive her to her parents house to drop the kids off.

That's how it'd work here anyway. I bet small town Minnesota isn't hugely different.

This was my first thought. Nick and April said nothing, got arrested and booked. Kayla was probably a weeping mess, pulled aside alone and spilled her spaghetti about the alcoholism, drugs, her trying to stop the spiral, how much she really loves Jesus, muh kids, boo-hoo hoo, etc…

If there was a pull up moment for Kayla this was it. You'll note April was taken into custody first, Rackets five minutes later, but our wife well over an hour later.

My guess is they stayed with her while she arranged for the kids to be taken somewhere safe and talked to her. They may have only taken her into custody later. If so, she may have given a statement incriminating both Balldo and April and as dumb as that is without a lawyer present (unless she actually did get one), they're probably not really as interested in her as in Balldo.

Nick is an absolutely subhuman piece of shit for subjecting his kids to this white trash C.O.P.S. Short of getting naked and fighting them (which for all I know he did), he couldn't be any more pathetic and worthless. It probably won't happen but I hope he ends up enjoying prison.
