I'd put the chance for a complete first draft at less than 10% and "mostly written" not much higher. He would brag relentlessly about it if it were any different.

Or does it? IANAL but if you file and win for something like defamation or another civil tort do you have a stronger ability to acquire your fees/damages? Vs. Quasi who was awarded fees because he was dragged to court and successfully defended himself. What I'm getting at is if someone with the grounds to sue for defamation and have pat as a defendant and they win can we finally crack open the pepperoni, so to speak, and finally see how he's making money (insurance, airbnb, Niki, other side job) to fuel his copious amounts of beer gulping and tweeting.

Some kind soul should still try in an effort to obtain custody over the rustang and finally put it down. Poor thing. Suffering, left outside with no cover, and its owner taunts it with threats of a “new coat of paint.” Long past its prime, and it deserves to be taken to a scrapyard where it can finally rest and, hopefully, melted down to make a second, better car.

If you win a legal judgement against pat you can go after income and assets - and that process takes time but was about to be done with Quasi. He or someone adjacent to him paid $84k to avoid that happening.

Fats apparently has at least a hovel, so you can at worst lien that. You could also potentially (if it took long enough) get other assets such as his copyrights.

Theoretically, a judgement against him [for defamation & tortious interference] would - depending on the laws of WI - subject him to seizure of various assets and a levy against income. If WI follows the doctrine of "tenancy by the entireties", it's unlikely you'd be able to immediately seize jointly-owned assets [the half-hovel, for instance] but the two of them wouldn't be able to sell it without satisfying part of the judgement. And judgements accrue interest as you saw with Quasi. The last thing anyone wants, aside from a public record of a criminal conviction or their L in a legal matter in which they were the Plaintiff, is a lien on their property.

What Leslie and Mike are discussing is Dan potentially seeking a restraining order against Fatboy for what appears to be a blatant attempt to economically harass Dan based on false allegations of criminal acts. That may or may not be equivalent to tortious interference w/a defamation component. Dan, it could be argued, is both an involuntary/limited-purpose public figure who would have to prove actual malice, though given the fact that Fatboy is very clearly attempting to harm his employment via a false allegation of criminal acts, that might not be a huge hurdle.

In a sane & righteous world, Dan has a case; this is neither a sane nor righteous world, so we'll have to see what happens.

Correct me if I'm wrong, but wouldn't Dan getting a protective order against Pat also prevent him from discussing Pat?
Long as you're not contacting them or getting a third party to contact them it should be fine. However it's easy to claim you're contacting Patrick because of Dan. This also means Dan wouldn't be able to get any information on Patrick so he would have to decide which is better.
 
That's probably the main reason he hasn't gone for one, is that the court usually (but not always) has as a component of a restraining order "stop poking each other".
Fatboy is a public figure who chooses of his own volition to use social media to make at best highly inflammatory/at worst vulgar and disugsting comments about people and topics and is, rightly, ridiculed for it - and falsely accuses his ridiculers of criminality of all flavors. Beyond that, he's fat; not that being fat is a crime, but when you verbally abuse women and repeatedly claim that people are criminals who will be going to prison because you're so mentally diseased that you want to pretend you aren't fat, you've earned all the criticism hurled at you.

Dan does a podcast ridiculing and discussing unflattering but largely factual information about said public figure.

The two are not the same.

if you want a restraining order against someone, the courts position usually is that they want you both to leave each other alone, go no contact, stop interacting with each other. they won't give you one sided protection while you continue talking shit at the other guy.

if dan thinks pat has gone too far in their dumb internet beef then he can try to sue him for attempting to get him fired, but bringing a lawsuit is much more expensive and much more difficult than just getting a restraining order.
 
Exactly - though people DO use a restraining order as a shield whilst continuing to be an ass, the courts aren't stupid and don't like it. Free speech in the USA is held at high enough regard that they're pretty loathe to restrict it.

Now Dan's company likely could get a restraining order of some sort if fats became unhinged enough, but simply mailing letters now and then probably doesn't reach to that height.
