You're right. I actually liked a lot of the flash tub animations Shmorky made. Honest hate, Shmorky has talent. Vito does not. I also think old school Lowtax was funnier than Dick when he was popular, but it's subjective and depends on how old you were at the time, I guess.
Dick and Vito are like Lowtax and Shmorky got teleported into the Dark World from Zelda and mutated into ironic versions of themselves.

Whenever I think of something good shmorky did theres stuff like that catchy fliptop box song and countless other animations.
Vito just had two videos where he bothered UCB protests which were ruined because they weren't edited down enough, and you see his bad improv on display. I think it would be really interesting if Maddox hired a competent attorney this time. California has more stalking/harassment/unfair competition laws than probably anywhere in the nation. I'm sure Daxipads decade long hate boner has violated atleast one of those laws.
Fair use analysis generally leans heavily against the early release of commercial works because they are basically automatically a market replacement.

If fair use covered leaks then we'd have a shit ton more media leaking early under the guise of "fair use." Even things which have already been released, but in extremely limited circumstances can't be reproduced with that excuse (J.D. Salinger's "The Ocean Full of Bowling Balls" being a pretty immediate example).
