Will Nicholas Rekieta take the plea deal offered to him?

Any normal person would get out of this without long term problems -- where I live by far your biggest problem would be that now CPS is going to be up in your business for a long time.

But Lolcows are lolcows because they aren't normal people, and there's a non-zero chance that Nick manages to be the only person in the last X years to get a custodial sentence for a first-time drug offence.
 
Could they avoid felony charges if Nick said "Yes I am taking responsibility and admitting that twenty of those cocaine grams are mine." and Kayla says "Yes and five of them were mine."?
Oh god no. The State will make Nick a convicted Felon, take his guns away and have CPS crawling up his ass for the next decade.

This is the minimum offer. Nick eating shit, becoming a felon, and avoiding jail. He should take the offer. And he won't.

He's going to fight this, he will lose, and he will serve hard time.
 
Looks like the future hearing was scheduled yesterday. The public calendar only goes out a week. I'm not sure if there is a better place to get the date of the hearing.

What are the odds he chooses to employ the absolutely innovative and fantastic strategy he has used with his traffic tickets? (i.e. no showing), and what would the potential consequences of this big brained strategy be? I mean big dogging the legal system into submission and getting a pardon aside, which is totally going to happen.

Bench warrant, and his bail is revoked. Would be very expensive and not smart to do. If Nick was smart, he would be using this time to get an Attorney, and that guy would make sure he shows up, among other things. but as we've established he's not very smart. He just thinks he is.

I would say the odds of this are low. Fighting a misdemeanor speeding ticket in court is borderline pointless, if you weren't able to get the radar evidence suppressed based on faulty equipment / poor maintenance, then you're basically only going to court to see whether the cop actually remembers to show up to testify. If they do, you're guaranteed going to lose.

If I'm inclined to believe the worst, then I'd speculate that Nick's intentionally making the cop show up to court just to be a dick. But he's not bothering to show up himself, because, what's the point? All that happens is he's in default and has to pay the fine, which would happen regardless.

Fighting felony charges is a whole different matter, he can't afford to play games or it will go very poorly for him.

She also volunteers with the Minnesota State Bar Association Mock Trial Program.

Instant bail revocation and a bench warrant they'll actually pursue as immediately as they can, and probably an additional charge of failure to appear. And he'll get to enjoy jail while awaiting trial, or it will be jacked up to some immense amount. The bonding company will probably also get a lien on his house and maybe even foreclose on it.

I've done this a half dozen times. Three of those, the cop didn't show. Two of the others, they reduced the fine slightly. The last time, I got to change it to an infraction with a much higher fine but no points, saving me thousands in insurance over the subsequent years it would have been on my record in a state with utterly insane insurance rates even with a perfect record.

Also, I never got a worse result for showing up than I would have otherwise.

That said, if you do show up but are obnoxious and drag it out even when you're obviously guilty, they will give you the max for wasting their time. And the other downside is they always take care of the people who are just showing up to plead and pay the ticket all in a bunch at the beginning, and if you are contesting it you get moved to the end of the line.

Neither has hired an attorney.

Nick thinks he's actually a good attorney so I don't think there's hope for him.

Kayla, though, needs to consult with a criminal defense without Nick present. She needs to explore whether their criminal trial can or should separated. She needs to explore plea agreements. She needs advice from someone that isn't a co-defendant, an addict or alcoholic.

Even though it's in her interest, Nick would be against it. His personality is such that any plea agreement will have to look like he fell on his sword or took one for the team. If she got her own attorney and negotiated something independent, even if the terms were identical, he would freak out. Even in his cuck world of drugs, polycules, infidelity, alcohol and child neglect - he's going to need to have any agreement look like he's chivalrous and made sacrifices. If she gets her own lawyer, he'll be mad at the implication that she made decisions not blessed by Law Pope. I think he'd rather have both of them sent prison before separating their cases where his decisions don't benefit any one else.

He really wants to be able to say "I would have fought these accusations, but I couldn't risk my wife and my children's mother going to prison. So I accepted their plea agreement." Not going to happen gets her own attorney and separate negotiations.

I'm sure Nick's already telling April that she's not charged because of he said the day of the arrest. She's not smart enough to know that the whole impetus for charges is the kids and they never wanted to charge her.
 
In case you were wondering who Nick was facing, it's a lawyer with equally unimpressive credentials, except for the fact that she has actually practiced law. She has only ever practiced in Podunkville, Minnesota, but has 10 years of experience there. The law school name should be familiar to Rekieta watchers, although I don't think they were classmates.

Apparently she is the First Assistant Kandiyohi County Attorney currently. I also found her LinkedIn, confirming her career as a lawyer who has never even thought about anything outside of small-town Minnesota. From the photo, I assume it's equally likely that she'll eat Nick as putting him in jail.
