Will Nicholas Rekieta take the plea deal offered to him?

in order to believe rekieta's bs, we have to take the following leaps.
  • 25g of coke. rekieta's take: silent. what we can infer from rekieta: not his drugs. it was either planted by the cops or it was aaron's or it was his 16 y/o son. probability = 5%
  • shell casings and guns at the scene. rekieta's take: it shell casings were an art exhibit and the guns were locked in a vault. probability = 50%
  • aaron's stories are all bs. rekieta's take: he is a liar. probability = 30%.
  • child neglect as reported by the church members and pastor. rekieta's take: they are just out to get him. probability = 10%
  • the cps report. rekieta's take: cps are lying under oath about what exactly happened. probability = 30%
  • the 9 y/o testing positive for coke. rekieta's take: deflects to the cps report being false. probability = 5%
all the major facts in this case (the drugs or the 9 y/o and coke) are not disputed by rekieta as lies or explanations. but the other stuff (guns at the scene, the reports themselves, etc), rekieta has an explanation for.

question for the thread, lets just take rekieta at his word 😆. lets say, as unbelievable as it sounds, rekieta's situation was an elaborate conspiracy from his christian church, with association with the local left-wing government, to lock him away for a long time. that there was no coke at the house, or the cops planted the coke. that the positive test for coke on the 9 y/o was fake and planted by the lab. and that the guns were locked in his garage. and that he did nothing illegal.

what benefit would it be to stay silent to the 25g of coke and the positive test for the 9 y/o? if all of this is a deep state conspiracy, then there is no way out for rekieta. he should do like samson and just collapse the walls with himself and everyone else inside.
 
Why pay bail if CPS is testing you regardless? Is it just doubling up on the piss tests? I guess this means he might be sober after all. Might be.
He has to pay for every test. Also not sure if people realize but if his kids go into foster he is required to pay a form of child support for it. Everything CPS wants him to do he will have to pay for.

He's absolutely a fool at this point. Prosecution is going to get in front of a jury, show the crack den, play stream clips of him coked out of his mind, and tell the Jury that his 9 year old tested positive for cocain use at well above the required minimum.

The Jury will want to hang the man themselves. He's definitely losing custody too, without a doubt. He can maybe get it back in the future, but CPS is going to be so far up his ass the whole way he will never be fully free of them.

Photos of the crack den and the safe full of coke along with the test results of the 9yo is all it's going to take to get a jury to convict. Regular people will be horrified by this. There is no fight. It's little league vs the New York Yankees.

As someone born in a small midwestern town and who has lived the majority of their life in various sized-midwestern town.

As soon as they hear the girl ask the cop for clothes and food, and learns of the coke in another child? They will be apoplectic. They will want the death penalty and to throw the lever themselves. Any defense he makes would only make him look -worse- in their eyes. Even the judge likely will be fighting back the desire to inflict the maximum possible sentence out of sheer disgust.
 
I have no idea of American law but would the prosecution use this to revoke his good boy privileges in terms of first offense. They could use his constant speeding too if they really wanted to be petty and say the only reason he does not have a record per se is he kept paying fines etc.
Traffic violations are separate from criminal charges, you pay the fine and they also impact your ability to hold a driver's license unless you also pay for and complete traffic school (unless you successfully challenge the ticket - generally costs more than the ticket. He has taken this route and failed to appear for April Imholte, I'm not aware of his performance for himself).
 
Apologies, but where is the document with the mention of one of the kids asking for clean clothes? I read the application for a search warrant that mentioned the reports to the pastor, state of the house, Nick throwing the warrant on the ground, but didn't see that bit. Is it in a different document?

Nicks recent behavior on traffic tickets is just to ignore them and get automatic convictions on them. He may have as many as nine violations in the last two years. His most recent violations were for things like expired tabs and expired insurance in addition to 25 miles over (I think) & weaving in the lane. He also refused to roll down the window and yelled at the police during his last known traffic stop.

My reading of the law is that he is currently in extreme danger of a drivers license suspension.

Seriously, they were already pretty fucked when they were just looking at a presumption of neglect just by having the drugs and guns around, but at least in theory, they could have rebutted that and got a not guilty, and the prosecution would have been more inclined to use that charge as a plea bargaining chip.

Now, short of a second, better test that comes back definitively negative, they have actual, proven abuse/neglect. And this is just assuming the most benign interpretation of accidental exposure, but if there's been one constant in nickfuckery, It's Always Even Worse Than You Know.

I had one who FTA'd several times in a row because he got drunk/high, when I'd managed to get him a very good deal if he could be bothered to show up.

Not a great idea to potentially send his spergs after a cps worker. If she gets any harassment it’ll be an awful look for him.
