It’s going to be an exciting month for Kiwi Law happenings in general. Patrick Tomlinson’s fraudulent (and fat) lawsuit against his local police department has some things scheduled for then, and I feel like I am missing another one as well (Greer lawsuit stuff maybe).

In any event, I’m very much looking forward to the laughs about a month from now.

@Useful_Mistake I didn’t see your comment until too late but can Randazza in theory fire Nick at some point for (future) inability to pay?

He can either negotiate with Nick to get out of it, or he can wait til Nick actually doesn't pay him and then get out of it (probably).

There's ways to quit even if he is getting the pay agreed to, but it's pretty difficult and Nick will hold the big gun in that fight if it comes down to it.

But mainly, no, he can't fire Nick just because he thinks he won't get paid.

Nick hired Randazza not the otherway around. But, if Nick doesn't pay up, he could ask the court for permission to withdraw from the case.

The raid by the Police changes things for Nick now.

I think the mere fact we think him hiring Randazza was retarded means that Nick will continue to keep him on.

Maybe things will happen in this case and provide entertainment while the Greer case sits there doing nothing.

It’s cool. When Nick gets blackout he forgets too. It’s why he does stupid shit like double down on pedophile accusations and hits on a MAN(dy) posing as a woman. How he hasn’t died of humiliation is beyond me.

Theoretically, yes, but there are restrictions.

His best bet might be the last sentence of paragraph 7. Namely in the form of Rekieta not shutting the fuck up, and continuing to double down on acting like a jackass. He might have a good case for withdraw on that basis

As others have said, the best chance is Rekieta just flat out stops paying him (paragraph 8 ). I think that one would be a slam dunk.

It's usually granted if it's been explicitly contracted, and it isn't an overreaching self-favoring agreement. Lawyers are not supposed to play silly buggers with retainer agreements and courts can disregard them. I think that would be a lot more likely if Nick were a layperson, though. As a lawyer, Nick is presumed to know what he's contracting, and not to expect a lawyer to work for free, and especially not to expect Randazza to work for free.

I have heard that the magic words in America Land are 'Your Honour, my client and I have irreconcilable differences, and I petition the court for leave to withdraw.'

Is it just that simple (beyond a farcical showing), or have I been misinformed?

That's the idea, although you likely have to elaborate. Generally, if there are irreconcilable differences you get fired, instead of petitioning for leave.

Nick talking about his own criminal case wouldn't be enough to withdraw. Nick disparaging the judge or other attorney might be enough. Nick continuing to defame plaintiff after ruling that it was defamation would be enough.

It would be interesting to know how Randazza is being paid. Randazza may require a certain amount deposited in anticipation of fees. For both Randazza and Nick, the retainer/deposit might be enough to complete the case and it's cleaner for both of them to finish the case with the amount they have. Nick doesn't have to come up with more money for Randazza or a deposit for a new attorney and Randazza doesn't have account for refunds after being fired.

I can see Randazza flat-feeing the rest of the lawsuit for the amount on deposit.
