I know a guy who was on probation and got arrested for drug possession and they ordered him to rehab - that or go to jail just earlier this year. He took the rehab. It's been 9 years since Austin's probation started and the offenses are not substantial. They will not throw the book at him.
I wonder, but he also has a domestic. I think the context around the domestic would be important, him taking a swing at his brother is different than taking a swing at mom or dad.

Think about the dynamic in that household at the moment. Austin is fresh off his 200k++ loss, lost his sponsor, lost more free money, is in a sustained crack psychosis and is at the height of his paranoia because of trolls/addiction/mental illness/embarrassment. BossmAndrew is having problems with his own family and is forced to return home, and you know he has had several conversations with Ratdad about Austin being a druggie POS and the problems it causes. He saw Austin's room, the junkie wares all over the floor, broken shit, Austin has lost ~20lbs in the last couple months, and he stays up all night screaming and slamming shit. He talks to his parents like less than garbage. It could've been as simple as Austin yelling at Ratdad and his brother telling him to knock it off, and like eddie, the switch flipped and paranoid cracked-out austin started fighting with Ratbro for making him feel weird and not loving him. Scuffles happen.

What I'm really curious about is who called the police? Considering his parents are absolute tier 1 failures and the definitive example of enablers, I have a hard time seeing bossmom or ratdad making that call.
I think there is some chance his parents were the ones who called. I think this is pretty much exactly how it happened, but I think his parents may have drawn the line when their son got punched, even if it was their other son doing it. It really doesn't matter who called though, because when the cops got their, Ratdad and Bossmom must've backed up everything BossmAndrew said. They knew better than anyone what getting arrested would mean for Austin. If they didn't want him to be arrested they probably could have prevented it, but part of them must've known he needed it.

It's true he did something that qualified as domestic violence, but it wasn't a general member of the public and it makes a difference. I am not saying he won't do possible jail time, but the idea the judge would "throw the book at him" seems like a near impossibility, he didn't do anything to earn the ire of the judge, he didn't rob someone, steal a car, wasn't caught distributing etc. etc.

Having said that I've no idea if he did something so bad that someone went to hospital, but on the face of what we know, he isn't up for a kick in the head from the judge, but a slap for sure.

I'd say the streaming days are certainly over and we will pick up on BMJ in 6-12 months after he has completed rehab.

lol, he isn't completing rehab and we all know it. A week in county isn't going to buckbreak Austin. He might take a deal where he chooses rehab instead of prison, but that's not where the story ends.

Well like the guy I know who took 12 month rehab for an offense committed while on probation, you don't get to decide if you are going to complete it or not.

You complete it, or you go to jail. It's cut and dry, you walk out of the rehab, a warrant is issued and you go to jail for the full sentence, and then the judge will throw the book.

Exactly. He can't make rational decisions at this point. Austin's existence has been divorced from reality for years. It's been drugs, gambling, and enablers. That's all he knows. He's not all of a sudden going to start following rules. I personally feel him not going to jail and going into rehab is where he becomes dangerous. He's impulsive, violent, and unhinged enough to make some kind of "I ain't going back" promise to himself.

They had to know Austin was using drugs, and they knowingly allowed him to possess and use drugs within their house. Like they kind of knew they were in possession of drugs by proxy, they knew illegal substances were under their roof and didn't do anything about it, is that possibly illegal?

I mention this while acknowledging I'm a moron who knows nothing about criminal law and I'm on my fifth independence day beer. To reiterate, I am retarded.

I don't see the point when there is a crackhead with a criminal history causing domestic violence. DA like convictions and going after Bossmom and Ratdad when there is an obvious crackhead seems like a waste of money and not a sure. We don't even know what happened when the police arrived. Did Austin cop to the crack like Nick did to the coke? Was it found in Austin's room or on his person? Technically it's the parents' house and if there was ambiguity based on where it was found the DA could potentially try to fuck the parents I guess.
