Steve Quest (p/k/a Montagraph) vs. Nicholas Robert Rekieta & Rekieta Law, LLC (2023)

Racketa is such a piece of shit who belongs in prison, but straight up not paying the courts... I can't bring myself to think that's bad. Fuck the courts. Has anyone ever tried his innovative legal strategy of just not paying? They say they are going to send enforcement but it's 300 bucks. Are they really gonna send someone to go get his ass over that? The police are lazy retards with more important shit to do.
Reread the order.

He's not paying MONTY. The court is threatening to enforce collection on behalf on MONTY.

I, for one, support Monty (and by extension, the court) on this one. Monty successfully fended off Nick's appeal, fair and square. Nick should pay Monty his goddamned money.

execution may be issued for the enforcement thereof"
Ah, finally the State is giving Nick the death penalty for his lack of fee paying. It was only a matter of time, I'm just amazed they weren't willing to wait until the end of the drug bust trial.

In seriousness, I now fully believe Nick is the nigger he thinks he is. A stack of tickets and fines that he hasn't paid all year is peak nigger. And I'm sure all this will do is make the judge think even less of him when Monty's case moves forward.

Something else interesting is that he didn't pay the latest property tax on the house that's in his and Kayla's names, Bobby did. Is he being full on petulant child or has the snack drawer run dry in the Rekieta crack den as has been speculated? He was trying to get Lady and the Cuck to buy that house afterall. I'm willing to wager he did not put up the cash for the bonds either.

Does anyone have an idea of what his angle is here?
Beyond the ideas already mentioned (Nicks anger, rage, spoiled entitlement, self absorption, & his wannabe martyr free speech posturing) it points to one thing. Devil may care looks a lot like a death wish or suicidal ideas.

This is Nick though so it’s just as unlikely. Particularly when looking at his public facing persona as well as his always visible ego. He has mentioned things which he likes playing off as jokes, the “I’d love to kill myself man,” schtick he sometimes falls into when talking about his stress & “very difficult life.” Sometimes a kernel of truth lies within.

In a study of people who committed suicide but lived, a common thread appeared. That was that they were almost all on the fence, 50/50, on whether to kill themselves or not. People often think suicide only happens when someone is committed when in reality they’re often only halfway decided. I’m of the opinion that Balldo is too selfish & narcy to do it, but then remember that suicide can be a very selfish act. When people give all their shit away, let shit go wild, they are sometimes found later at the end of that rope.
Did a pepperoni demon infest nick
Signs point to yes:

All signs point to yes.

Will they though? How many times had he ignored speeding tickets and gotten pulled over anyway without going to jail?
Eventually. They're generally not in a hurry. I've known people to get busted on an outstanding warrant literally years after blowing off shit like parking tickets.

He'd rather just have $1K or so gouged out of his bank account than man up and pay his debts, because he's a bitch-made little pussy with no ability to live up to his obligations.

Something about that is just so stupid. It’s not as if it proves anything either, except that Nick is a whitebread ass niggah. He has such brainrot, it wouldn’t be surprising if he sees it as standing on some lolbert principal that he “didn’t pay, it was forcefully garnished by da man, pardnah. ‘Tis what it is, man.” Surely all his peers will be so impressed. His cult will grow, he will have a qover again, surely.

Question for other Lawkiwis, and forgive me we already discussed this:
Is there a reason Rackets didn’t remove to federal court? They have complete diversity. And while the complaint on its face doesn’t meet the amount in controversy, it seems strange that Randazza wouldn’t at least try some argument that the requested TBD compensatory damages plus the 50k can meet that. It’s no less retarded than his weird conflict of laws argument.
Is the MN federal court just not favorable enough for Rackets to cough up the cash for that?

Has anyone ever tried his innovative legal strategy of just not paying
Yes, plenty of people. It doesn’t work, the government will get its money from you. And refusing to pay only makes it worse.

Let's be real here. What this is is that the narcissistic self-righteous arrogant faggot can't bring himself to write a check for $300 with the knowledge it's going to Montegraph. It's not that he doesn't have $300. It's that he's a petulant POS, and a sore loser.

Nick is a bitch. Hopefully his continued recalcitrance will end with him being bitch slapped hard. Both on this, and his criminal case. He deserves it.

Is there a reason Rackets didn’t remove to federal court?
Why would he?

Does anyone have an idea of what his angle is here? Nick is smart enough to know that fines don't just vanish, and that they can accrue. He (assumedly) still has the money to pay. Is it defiance? Why wouldn't he just settle these small payments quickly and neatly, considering he has much bigger problems to deal with right now?
Nothing really matters and there’s no long term planning when you’re actively on drugs.

Why would he move this to federal court?
Why would he?
It tends to, or at least has the reputation of, favoring defendants more than state court. Other reasons exist as well, like a stereotype that federal judges are better/smarter than state ones. and some lawyers prefer how federal courts apply state law in diversity jurisdiction cases.
As I said, IDK about his district in particular, so none of that may apply here. But it does seem odd to me to not try.

I am sure he needs the $300 for his gift to his locals subscribers.

Home state rule.

"A civil action otherwise removable solely on the basis of the jurisdiction under section 1332(a) of this title may not be removed if any of the parties in interest properly joined and served as defendants is a citizen of the State in which such action is brought." 28 U.S.C. § 1441(b)(2).

Monty brought it in Nick's home state, possibly specifically to avoid diversity jurisdiction.
Why would he move this to federal court?
Why would he?
Because every single local judge personally hates his guts?

Well, that, and also I am sure that the thought that Minnesota still technically doesn't have an anti-SLAPP played some role.

The way this whole thing has played out is really hilarious, if you think about it.

Nick: Sue me, faggot!
Monty: Okay. *Sues*
Nick: Shit. You actually did it, AND you got a lawyer this time too. Go go Randazza! Get us anti-SLAPP!
Randazza: I failed.
Nick: Fuuuuuuuuuuck! *Does more coke, gets arrested for it a few days later*

All of this could have been avoided if he weren't a dipshit with more money than brains.

And whose fault is that?

Mind you, I'm not sure it can be said with any certainty that Fischer hates Nick's guts. Though he sure as hell hates her.

My presumption, until proven otherwise, is she doesn't give a shit about his verbal diarrhea, and is capable of being impartial and applying the law correctly.

Nick is pissed at her because he fucking lost. Because he is a dumbass, and the law simply isn't on his side. He's a man baby. He deserves to eat shit on this.

I thought the parking tickets and the $300 was just laziness or inattention. But I realize he can't just walk away he has to act like a petulant child about this. It's his way of coping with losing. It is not too similar to how Ralph when someone would say something that wasn't 100% in Ralph's favor he would instantly flip and say the worst possible thing about that person to make himself feel better that he was getting made fun of.

Nick feels bad because he lost the appeal and he has to do the stupid petulant thing to make himself feel better.

That is the thing that continuously amazes me about Rekieta is I keep subconsciously thinking that he will figure out that he has been retarded and then realize he should go for the smart option even if it is a bit painful. But he continuously doesn't make this decision he continuously digs himself a deeper grave. I've seen him do it so many times that it shouldn't surprise me but somehow it does because he always picks the stupid option.
