Nick & Kayla are filed a report with the police about the incident of Aaron sharing Kayla's naked photo with Geno. (Personally I doubt sharing a single photo that went no where else with one person counts as "revenge porn." Nick is grasping at straws to get either some payback or leverage on Aaron. Aka, "We will drop the revenge porn charges if you don't testify against us in the drug case."
The statute says "distribution to one or more persons" so it probably technically counts.

Also if Nick is doing this for that purpose, he'd best be careful because that's something called witness tampering.

Subd. 2.Tampering with a witness in the second degree.​


Whoever does any of the following is guilty of tampering with a witness in the second degree and may be sentenced as provided in subdivision 3:


(a) intentionally prevents or dissuades or intentionally attempts to prevent or dissuade by means of any act described in section 609.27, subdivision 1, clause (3), (4), or (5), a person who is or may become a witness from attending or testifying at any trial, proceeding, or inquiry authorized by law;
And what's that statute it cites?
(5) a threat to make or cause to be made a criminal charge, whether true or false; provided, that a warning of the consequences of a future violation of law given in good faith by a peace officer or prosecuting attorney to any person shall not be deemed a threat for the purposes of this section
So if Nick actually does offer such a quid pro quo, he's committing another crime.

For the moment, though, I'm going to consider that he's probably just being a petty little bitch and that nothing is likely to come of this, although I thought the same about Ethan Ralph's revenge porn charges.

This sounds an awful lot like Geno doesn't even have the photo, though. Otherwise why would he need to describe it? Without the actual photo in evidence it's just something Geno says. I can't see them prosecuting based on this.
 
Charges would be pretty stupid for this, but I could see Nick and Kayla using it as an entry point for some type of restraining order or harassment prevention order. The letter of the law doesn't give a shit about how big of slut someone is or how many pics they post online. That's more an argument that the action did less harm than what Kayla would presumably describe.

Not a law man, but I doubt that Aaron has sent anything that the Crackietas's haven't already shared publicly. At least I hope for his own good that he isn't that dumb. If they tend to file a report, then Aaron's best defence would be to start digging for places where the Crackets polycule might have already shared that image.

Yes, Geno has deleted the photo. We don't know if Aaron has deleted the photo yet. (Could deleting it now be considered destruction of evidence?)

As to the existence and admissions of the act there is full evidence of Aaron sending Geno the photo while streaming and discussing it on stream. I think that there is so much evidence that the photo existed and what was done with the photo that they may not need it.

It just seems like such small potatoes that it wouldn't be worth charging him. That is unless the St. Cloud wanted some easy charges to up the officer's stats.

On the flip side, I could also see the Spicer, MN prosecutors asking the St. Cloud prosecutors not to pursue this as the Rekietas are obviously fucking with a potential witness who is being very cooperative.

And what is the real harm to Aaron? A plea deal for a misdemeanor, maybe a fine as a first time offender? Maybe even striking a deal to let this fall off of his record after a certain amount of good boy behavior time?

The absolute worst that can come from this, since Aaron isn't fighting the cops, is that Nick would then start calling Aaron a "convicted revenge pornographer'." That is it.
 
Here is the Statute in question

617.261 NONCONSENSUAL DISSEMINATION OF PRIVATE SEXUAL IMAGES.​

Subdivision 1.Crime.​

It is a crime to intentionally disseminate an image of another person who is depicted in a sexual act or whose intimate parts are exposed, in whole or in part, when:
(1) the person is identifiable:
(i) from the image itself, by the person depicted in the image or by another person; or
(ii) from personal information displayed in connection with the image;
(2) the actor knows or reasonably should know that the person depicted in the image does not consent to the dissemination; and
(3) the image was obtained or created under circumstances in which the actor knew or reasonably should have known the person depicted had a reasonable expectation of privacy.

Subd. 2.Penalties.​

(a) Except as provided in paragraph (b), whoever violates subdivision 1 is guilty of a gross misdemeanor.
(b) Whoever violates subdivision 1 may be sentenced to imprisonment for not more than three years or to payment of a fine of $5,000, or both, if one of the following factors is present:
(1) the person depicted in the image suffers financial loss due to the dissemination of the image;
(2) the actor disseminates the image with intent to profit from the dissemination;
(3) the actor maintains an Internet website, online service, online application, or mobile application for the purpose of disseminating the image;
(4) the actor posts the image on a website;
(5) the actor disseminates the image with intent to harass the person depicted in the image;
(6) the actor obtained the image by committing a violation of section 609.52, 609.746, 609.89, or 609.891; or
(7) the actor has previously been convicted under this chapter.

Subd. 7.Definitions.​

(a) For purposes of this section, the following terms have the meanings given.
(b) "Dissemination" means distribution to one or more persons, other than the person depicted in the image, or publication by any publicly available medium.
(c) "Harass" means an act that would cause a substantial adverse effect on the safety, security, or privacy of a reasonable person.

Making this complaint is pretty retarded on Nick and Kayla's part for several reasons:

First, Aaron has a decent argument that element two of the charge is not met. If he can show that he, Nick, Kayla, or April have previously shared any nudes of each other with anyone outside of the polycule and there was no issue with it, then he can argue that it wasn't reasonable for him to believe that Kayla would not consent to this dissemination because he and the person it was shared with were simply discussing tattoo placement. It isn't present in this statute, but most revenge porn statutes require that the distribution was done with intent to harm, and though I haven't checked I would bet that Minnesota case law takes this into account.

Second, it will be extremely hard for the state to charge Aaron with anything more than a gross misdemeanor. The state's best argument would be that Aaron did it in order to "harass" Kayla, but since it was only one distribution to a single person while they were discussing tattoo placement, that is a hard argument to make. So the legal maximum punishment Aaron is looking at a $3k fine and 90 days in jail.

Third, this is a criminal matter, not civil, so it is completely in the government's hands now. While prosecutors do take a victim's willingness into account, they do not have to, meaning that if Aaron decides to fight this and that results in more polycule info seeing the light of day, and then Nick and Kayla decide they would rather just drop the whole thing, they can't.

Fourth, potential witness tampering.

Finally, it is hilarious that the man who has ranted about how government is so evil and bad for not allowing him to do cocaine around his children, and has previously posted lewd photos of his own wife onto the internet, immediately goes crying to daddy government when the man who cucked him sends one picture to his buddy.

Aaron is fucking retarded for sharing that image and doing so on a livestream, but this is just silly.

Whereas if they reported it to the Spicer police, they would open themselves to long consensual conversations with the police who want to know more about matters that they are currently charged. At least Nick is smart enough to know that is a bad idea.

Of course Nick is a bit of an idiot if he doesn't think the cops from the two different small counties and the DAs from those counties aren't going to call each other and compare notes, and take into account the full picture before pressing charges.

It was a low effort easy punch to throw with potential high pay off if Nick got the cops to fight his fight for him against a witness.

I don't see how Nick could let down he got cucked after years of harassing Ron toye, Jack Murphy & destiny, and filing charges against Aaron is bitchmade. That's what makes this white trash theater so entertaining as long as you're not involved. The crimes generally don't reach truly abhorrent levels and the scheming is hilariously juvenile. I could see this being something where the prosecutors office in St Cloud has issues with Aaron and is looking to mess with him. His exwife might also be able to use this or have influence on that office. I would be amused if the whole polycule ended up with a criminal conviction for their swinging: that’s definitely karmic justice for their degenerate behavior.
