Trump has done none of this. Nor has he been charged. So you'd be laughed out the room. I'd like to see the dems try. But I think the Military and USSS would escort them out.
I seem to recall someone arguing that the President doesn't fall under any of those categories. Not a member of Congress or of a State's legislator, nor a member of the military.

Yes, it was an argument because president is not explicitly listed as he is not considered an "officer" was the argument (rather, he appoints officers under the advice and consent of Congress) under the appointments clause.

Haven't all the Democrat plans to use the 3rd Section of the 14th Amendment failed so far? Why do they think it will suddenly work if he wins?

They're going to argue that a president-elect is an officer (because Biden made that stupid office of the president-elect thing), and then they're going to drum up some bullshit thing about 'election interference' or 'voter suppression' or even just some X post as being an 'insurrection'.

It will be incredibly fake and gay and the Supreme Court will laugh it out of the courtroom but it will be enough to make Redditors screech about an 'illegitimate presidency'.

It would be hilarious if Dems case got thrown out on standing or Laches. From a completely uneducated perspective it looks like waiting until he’s already elected to enact it would be too late.
 
Supposedly Raskin is letting it slip they are going to invoke Section 3 of 14th Amendment should Trump win.

Raskin should try reading the Preamble to the Declaration of Independence:

We hold these truths to be self-evident, that all men are created equal, that they are endowed by their Creator with certain unalienable Rights, that among these are Life, Liberty and the pursuit of Happiness. That to secure these rights, Governments are instituted among Men, deriving their just powers from the consent of the governed. That whenever any Form of Government becomes destructive of these ends, it is the Right of the People to alter or to abolish it, and to institute new Government, laying its foundation on such principles and organizing its powers in such form, as to them shall seem most likely to effect their Safety and Happiness. Our enemies are not playing by normal rules, it's Calvinball. I'm still not convinced Scalia was natural causes.

it's funny how that was debunked years ago and there are some niggers still acting like it's true
as if some bastard born from jefferson and an almost literal one drop negress would be black or subsist until the modern day
