He's being a pedant. He knows he has implied that the cops planted the drugs. He didn't even try to hide the fact that he was implying that. But he's a weasel, he almost always speaks in implications and suggestions so that he has plausible deniability if he ever needs to deny that he said something.
So yeah, he never said the cops did anything wrong. But he definitely communicated that they did, we were all meant to understand what he was saying to mean that the cops planted the drugs.

This is where efforts to nail him for saying X or Y will fail. He's not that clever, but (the Montegraph comments aside, which were astounding) he is
careful amused with his own cleverness enough, and broad enough with his statements, to say something absolutely clear in its implication, knowing everyone will understand exactly what he's saying, but stopping short and letting his bulldogs say it it under color of commentary and speculation. It doesn't take even a wily 4th grader to know that observers would know exactly what he means and form the thought that he said it, even if he didn't quite.
Good lawyers are precise with language because words do matter, and they disclose those narrow distinctions upfront.
Hack lawyers are just weaselly, card-trick magicians, rolling around in the world of plausible deniability like a dog in shit.

He may skate, and it will be a disgusting travesty (getting kids back at any level so quickly is already a disgusting travesty), but for the avoidance of doubt, Nick Rekieta: if you weasel out of this without a permanent stain or everlasting hate from your children, just know it has nothing to do with your quality as a human, your (cough) quality as a lawyer, the quality of your representation, your correctness, your righteousness, or your vindication. Because those things don't exist.
If that happens, you will just be yet another tacky junkie negligent parent whose only achievements in life came as a result of someone else's fortune, overburden, or screwup.
