My uninformed opinion is that Nick's filing is weak and false on it's face. The idea that court can't broadcast any hearing prior to the jury being sworn is false. It's obviously false as Zoom is routinely used on all these hearings including Nick's first appearance. It's circular reasoning to state it's illegal to use Zoom because as they saw, Zoom can be unruly. The MN supreme court provides instructions on how to join pre-trial zoom hearings. Is the MN supreme court breaking the rules or is Rackets wrong again? It is an obvious misunderstanding of the rule to claim they "shall not" be recorded when the entire system relies on and uses it.

I wanted to address this because I have heard this talking point mentioned a couple of times and by Sean specifically, which I think is well-intentioned and on the surface well-reasoned but ultimately wrong. The critical difference here is that Josh and others are asking for permission to broadcast / record the proceedings the Court's proceedings, not the Court streaming its own proceedings. The Court streaming a remote hearing on its own is categorically different from permitting a third party to record the Court's proceedings (especially when the hearing is in person), which I don't fault you for not knowing, but a lawyer like Sean should have recognized. If you have ever been in a remote court, they specifically instruct you not to record or stream the broadcast, even though this rule is commonly broken.

The Minnesota General Rules of Practice specifically make this distinction:

Except as set forth in this rule, no visual or audio recordings, except the recording made as the official court record, shall be taken in any courtroom, area of a courthouse where courtrooms are located, or other area designated by order of the chief judge made available in the office of the court administrator in the county, during a trial or hearing of any case or special proceeding incident to a trial or hearing, or in connection with any grand jury proceedings. . . . For purposes of this rule, a hearing held remotely using video technology is not considered livestreaming and any recording or broadcasting of such hearings is prohibited unless specifically authorized by the presiding judge.

Now there may be a rule from the Minnesota Supreme Court abridging or otherwise altering the ordinary application of the rules for pre-trial criminal matters of public significance, but I didn't see any after a brief search, so I am going to assume the ordinary rules apply.

Apologies if this has been answered already, do we have any experts that can speculate on the pharmacokinetics of the cocaine metabolite levels in the 8 year old?In particular I am curious if these levels could be seen from one high exposure or if these levels can only be seen from repeated exposure, especially since the child had levels “consistent with daily use."

Looking at the literature, it seems that the metabolite takes about 3 to 4 months to clear (where I define “clear” as negative on hair test) with a half life of 1.5 months.
