This completely ignores that such laws were in place less than two decades ago, and regularly enforced until SCOTUS ruled then unconstitutional on the ever faulty “right to privacy” “substantive due process” theory.

Libertarian arguments regarding government staying out of people’s personal lives have a point, which is why I inquired how he proposed to prevent the decay of that agreement we’ve seen.

But arguments that such laws don’t work or can’t be enforced per se are simply wrong. They were in place and enforced up until 2003.

They weren't enforced. Most people arrested and charged under sodomy laws were male prostitutes, men who raped boys, gay men having sex in public, or bestiality shit. The latter is why bestiality was and is legal in some states, since the repeal of the sodomy law technically made fucking animals legal. IIRC even guys caught jerking it to gay porn in their car got charged with sodomy. Fair point, I didn’t have the data on enforcement, which is why I was only arguing against them not working per se. I’m fully able to believe they weren’t very effective or commonly used, because it would be difficult to prove charges against those who keep it in the bedroom.

I do sort of still see that as a win though, since it sort of enforces the idea of “keep it private and in the bedroom.” Though the more liberty minded part of me may still have concerns over that, even if it probably wins out to my social conservative side given our current climate.
