Then they go on to say that he privated the video on both platforms. Which is true, but they easily could have gotten a copy before then. He didn't private it until many hours later. I assumed they might have been watching live and gotten a copy immediately.

They're really gonna claim that stream didn't happen like everybody says it happened, aren't they?
I suspect the version entered into evidence isn't Nick's original. We do not have the evidence.

Welp, here's our answer. He's gonna fight...

Our prayers are answered, The milk will flow free in the coming months, my fellow farmers.

You show 'em, Nick. What the hell do these practicing lawyers know about anything? You need to stand up in court and object loudly at every available opportunity. Don't rely on that pussy Barneswalker to do it for you. That Baby Herman impersonating lamo can't be trusted. You should sack him, appoint Ralph as your Mackenzie Friend and represent yourself in this matter.

We're all counting on you.

Wut?

Altered how? The stream on his YouTube and Rumble channels is a full and accurate copy of the stream. It's even still up on his Bitchute, I believe.

Okay.

EDIT: Saw, not said
ah yes our expert kiwi editors must have edited in the "anime sucks.... cope and sneed" bit

From what I've seen of this Barneswalker's performance so far most of the arguments he makes are probably a little dumb but I don't know enough about the law to really have any opinion on them. What does interest me is that they're claiming here April was questioned by Detective Pomplun after she was read her Miranda rights and asked for a lawyer, and after Pomplun was told she had asked for a lawyer:

The citations for this are all just a bunch of as-yet unreleased .mp4 files unfortunately. Or at least, I don't know of them being released.

Wait, the Barneswalker's defense is actually "Your Honor, my client insists he deleted all the evidence?"
:story:

This is the video that the detective watched according to the motion
I think he means the channel link by "watermark". I don't think that is correct. Also, it's not modified as far as I can see
That screencap might be what they introduced into Discovery, but I think the warrant specifically said the detective watched his channel, and not Backwards Internet, didn't it?

They are trying to get the warrant invalidated. Just like most people here assumed he was.

Wait so is telling police you want lawyer and then signing like canary a get away from jail free card? I thought the whole point was that absolutely anything you say after Miranda can and will be used against you however is possible? And it is up to you to actually shut up... Maybe this is from Nick's law school...

It says "the video that was taken off" his channel which would seem to include a reupload. Screenshot taken from below post

Here is the whole search warrant posted as screenshots:

Again, they can review the original, and examine that one too, I don't see what the point of this is
Everybody saw the white on his nose after the second bathroom break. I was watching the stream live and saw it as soon as it was pointed out

No, he "privated" it and therefore it's not deleted. Enjoy prison

The officer doesn't say that he watched it on Nick's channel

I wonder if Barneswalker Frank will dress the part by coming to the hearing with a clown nose on? What a clown show it is, this makes no sense.

The application doesn't specify that he directly watched it on his channel

The Barneswalker says the video was "altered" but the only alteration he can point to is a watermark

WAIT A SECOND...

The watermark the motion says is "open and notorious" is in fact added by YouTube!!!

It's the YouTube channel watermark in the lower corner that provides a "subscribe' button upon hover. It would actually disappear if you downloaded the video with yt-dlp or whatever. :story:

Right.

I am admittedly not knowledgeable enough to know if this will work to get the warrant tossed. I'll leave that to the practicing attorneys. There might be some "best evidence" rule that requires the video they are using to be directly from Rekieta's channel, and not a copy from BI. It's also possible Frank is just throwing a hail mary and this is a B.S. defense.

What I do know is that if this does work in a legal setting, and he walks, it's not gonna work in the court of public opinion. Everybody saw what they saw, and @Peace Through Power correctly notes the BI copy is not altered. If it works, it screams "walking on technicality."

I always interpreted "taken off" as "downloaded from," but I guess that language could also support some other channel has "taken off" the video and the detective watched it there.
