Rekieta's team is challenging the authenticity of the video. There will be an evidentiary hearing and some motions by September 5th at the latest.
Lmao anyone who said Rackets already had a plea deal already is eating hat tonight!

I fully expect Rackets to be arguing about the fringe on the flag and sending fake leins to the judge by the end of this

I still don't understand this argument that they can't authenticate the cokestream footage and therefore it should be thrown out. The original footage is still available on Nick's stream. Is there any likelihood they disregard the warrant because the cops watched a secondhand copy?

That's not what I heard, but maybe the discrepancy is explained by Kayla already smelling like month-old rotten fish down there. Shortly after she walked in, according to one of my sources, one of the clerks made an angry call to Roto-Rooter demanding to know why they were draining the septic tank while court was in session.
 
So we've got an up to two week wait for the evidentiary hearing, then we have a 1 month+ wait for ANOTHER omnibus hearing? I feel like Nick's strategy is just to stretch this thing so that the prosecutor doesn't think it's worth the time/money to wade through all the extensions and throws him a sweet deal.

A full unedited copy of Rekieta's coke stream exists right? Are they seriously going to make to the judge watch every second of the "unedited" version of his stream for him to come to the exact same conclusion? Smart.
What are you talking about? It’s ALWAYS a great idea to waste hours of a judges time with frivolous arguments. It TOTALLY doesn’t just piss them off and needlessly piss away good will.
Its a high IQ strat that voluntary members wouldn’t understand

Hm I remember she was charged initially then were dropped. Then a few weeks later charged again. They might see her as a weak link to convict the other guilty members and must've said some damning stuff prosecutors could use. Unless I'm wrong about the history of her charges.

The wife has her own omnibus hearing coming now too.
 
Didn't he lose the ability to access that Odysee account as in he can't remove the videos from that platform?
He legally can't remove it because it's evidence (he's already charged, it's too late to make a "standard data retention policy" argument), but I'm not sure what the technical situation is.
 
if she basically admitted it how can they not use that in court? don't you wave your miranda rights when you start talking? or is it just that when you ask for a lawyer they can't ask you any questions till they're present?
It can't be used against Nick if April isn't available for cross examination because it's hearsay.

While it was reallly poorly argued we mostly agreed it was likely the April stuff was not admissable at trial (unless she pleads and turns on him and testifies) and they'd probably better get a better copy of the cokestream if they want it in at trial.
