Anyone who thought this would resolve quickly is clueless.So we've got an up to two week wait for the evidentiary hearing, then we have a 1 month+ wait for ANOTHER omnibus hearing? I feel like Nick's strategy is just to stretch this thing so that the prosecutor doesn't think it's worth the time/money to wade through all the extensions and throws him a sweet deal.
Your statements about what you did can be used to incriminate you. Your statements about someone else require you to testify. The jury has to be able to establish your credibility/sobriety/sanity. She has to take the stand for the prosecution and say "Yeah all that shit I said on tape is true" and face cross from Team Crackets if they want to use what she said to incriminate him.if she basically admitted it how can they not use that in court? don't you wave your miranda rights when you start talking? or is it just that when you ask for a lawyer they can't ask you any questions till they're present?
I know Uncivil was very focused on that and the Minnesota case law Barneswalker referred to relates to co-conspiracy, but as of now April isn't a co-conspirator and it's just a broad 6th Amendment concern that I think should be addressed later in procedure and they are trying to pull a fast one with it to get shit thrown out early.Basically my understanding as of now is that she is co-conspirator in the crime and as such it is singular case.
