That's an interesting point, and one that got glossed over. Hopefully that point gets raised should the case go to trial, and as support for streaming the trial. (It seems like Nick will not be taking a plea.) If Kiwis managed to fill the courtroom for a benign hearing, imagine what the full trial could be like? Especially if it keeps hitting the local news!

I kind of doubt they want to risk putting her on the stand. Her credibility as a witness is terrible (she is as much of a drug addicted swinger as everyone else in the house), and her doing something like telling the police specifically where to look for drugs in the house can be used to cast doubt on it being Racket's crack and not her crack. You don't generally want to prosecute crack heads by busting everyone in the crack shack and dragging some of them onto the stand to point fingers and say "yo hona we wuz all smokin crack but it was his crack in our crack pipe, he's the crack posessor." It turns into a shit show. Everyone has motivation to lie and throw everyone else under the bus. Everyone is drug-addled and bad at lying and unpredictable. Putting someone like April on the stand could torpedo the prosecution's case because she is a permafried coke whore and is going to act like one on cross exam. If they don't need her statements they will probably just concede and say "yeah, you can mute out the Nick-incriminating statements in the bodycam video. We have the drugs in his posession and in his kid's hair and all over his fucking nose. We don't need her."

Really the only questions I can see police even having for her is "do you live here?" And "is this your credit card in the master bedroom covered with coke?" I haven’t watched one of Rackets’ streams for a long time. Since he was gonna talk about his big win yesterday, I put it on in the background this morning while doing other stuff. Here’s some sort of random thoughts.

1. He seems really, really mad about the “non-practicing lawyer” claim. He gets an angry look on his face when he says that phrase.
I generally can't stand to watch Nick's disingenuous song and dance routines for very long anymore, but I watched some long clips on Sean's stream last night. Nick is usually very good at maintaining his facade of ironic, smug superiority, but the mask was really slipping this time. He looked like he was on the verge of angry tears in a way that I can't recall ever seeing before.

My eternal question, is Nick consciously lying, or does he believe his own lies? Was he getting choked up last night out of frustration, because people are seeing through his lies, or because the court's pushback is shaking his own faith in the bullshit delusions that reign in his head?
 
2. His position on the purpose of yesterday’s hearing seems to have changed. A while ago, the hearing was going to get the warrant quashed and the coke evidence excluded. Now it’s just a request for a Franks hearing on the warrant.
Well, they are the same thing. Franks is his angle on getting the warrant out. I think it's the last card he has to play. Even a good defense attorney would take a couple of swipes at probable cause and warrant execution, even if it's going to lose, before giving up on this stupid bullshit, getting Nick to take a plea, and focusing on arguing his sentencing down.

I think Nick is terrified of April on the stand, for the same reason he doesn't want her bodycam footage in. She is dumb as a box of rocks, and will sing given the slightest amount of pushback. She will try to do cute girl uwu, because the worked in the past. But the cops have seen the routine before, and it's not going to play well before a jury.

Also it will probably further blow up the qover, or at least accelerate it, and then Nick is stuck again with only Qayla's busted body.

Nick's lies of omission/weasel language are conscious. But his brain is drugged out enough that he starts to believe the lies he keeps repeating. He was faking emotion to try to pull sympathy from the audience (only would work on retards), and hopefully to hurt the rats who told on him.

Nick says that the Cop claimed to have watched his video ON his account, but since it was private, that would be impossible (even though he didn't private the video until well after 10 the next day since he was passed out).

Let's look at exactly what the warrant said.

What the cop ACTUALLY said was that he was able to review the video that was TAKEN OFF OF Nick's channel. Cog's reupload was Nick's video that was TAKEN OFF OF Nick's channel. If Nick wants to claim that Cog altered it then all he has to do is simply un-private the video and show exactly what Cog changed.

"They said they watched my video" but the ACTUAL statement was "(I) was able to review the video that was taken off of Nick's social media sites"

These are two completely different statements. Is he just a lying liar that lies, or is his brain so scrambled that he can't read correctly?

It doesn't matter where the video was viewed, that's irrelevant, but Nick is trying to argue that the cop intentionally lied about where he viewed it when he very clearly did not.

I feel like I haven't seen this posted in the thread yet, Dick Masterson had a Rekieta segment during his show this week where he presents his version of what happened (neither Rekieta's story nor the truth). Sean the Audio Engineer was given a very brief synopsis from their listeners in Discord pre-show, and is a bit surprised to hear Dick refute everything, though for context Sean doesn't really believe much of anything of what Dick says on the show nowadays.

I think the full segment is worth watching, but I included two clips in particular where Dick provides "context" surrounding Rekieta's custody stipulations as well.

There was a famous case with a doctor that got caught by Chris Hansen.

The transcripts were different in a dozen places, because one program transcribed smileys and another didn’t, so a judge threw them out…

Only to get overruled by another judge, because the minor differences didn’t make a material difference in the transcripts.

That was like a decade ago, and while I’m not a lawyer, I reckon there’s some established precedence with retards and non-practicing lawyers trying to use watermarks etc. as Hail Mary legal passes.
