It's a confrontation clause argument that April's statements violated Miranda, if offered against Nick then he would have a right to confront April on the stand, but because of the Miranda violation April would not be able to be put on the stand by the state to introduce her statements.

Except he didn't even really MAKE that argument. The conclusory statement at the end is that the state could only introduce April's statement if she were available for cross examination, NOT that they couldn't call her at all, which appears to be what the bulk of the section was arguing. In other words, it makes that argument, then undermines it at the end.

I'm not an alcoholic wet brain, but I'd wager he's trying to cut a fine line between not the original stream as compared to a second-hand copy that has been edited. Nick has the attitude of a magician who is really offended that you don't believe in magic even though they put all that effort into their illusions. This is what fascinates me about Nick. I'll try to stay brief. I think White uses the motions to dismiss as a way to suss out what the judge is willing to consider; he then writes a detailed brief for whatever the judge asks. This motion-hearing-briefs-decision pattern happened in both prior cases, and seems to be happening in the current case. For all I know the lawyers ITT are going to say "duh", or correct me, but I haven't looked at this before.

Based on very limited reading, the motion reads like White and not Rekieta. Obviously arguments he is already familiar with are better written. The April section just reads like an early draft to me. Either he half-assed it to keep Rekieta happy or wasn't given a lot of time (i.e. money) to draft it. He is clearly capable of doing better.

My two cents.
