Yeah, the judge argued that the title of the clip and the arrangement of the clip was enough to warrant a transformative nature of the work (and I agree, it was effective mockery). But it's a case by case issue and all of the fair use factors have to be evaluated.

In the case of Doody a big sticking point would be the question whether his videos usurp a part of the potential market and whether he's actually critiquing DSP or just using his content for it's intended purpose (entertaining an audience).

Notwithstanding: DSP would never really sue anyone.

Yes, and a big reason was that Sargon's audience is extremely different than audience of the bitch that sued him. I'd compare it to the libs of tik tok account that just reposts clips unedited, but for a much different audience and with the implied commentary of the account.

The way I see it anyone who's familiar with internet drama knows Keem's tendencies and tactics. Allowing your podcast to be hijacked by a well-known disingenuous nigger and letting him lead a pointless circular conversation is the equivalent of submitting to the gnome like a bitch. I may not have used the correct term but we can agree the entire "debate" was extremely gay.

If we're going by strictly legal stuff there is a precedent set by the H3H3 jew duo over what transformative work is. I think the ruling was something like "a work is transformative if it either appeals to an entirely different audience from the source work, or does not serve as a substitute for the source work i.e it can't be a 1:1 copy" not a lawyer so I'm talking out of my ass but it's the difference between Memology and Snort Hogan inserting clips and cut-ins and just reuploading a cut segment from a DSP stream, but a good enough copyright lawyer can probably argue that the presentation and branding of doody clips means that it fulfills the 'appeals to a different audience' part of the ruling.

Yeah and the bitch had to pay all the lawyers fees after gloating she would make Sargon poor. And the judge ruled "Those that come to Sargon would not come to her anyway"
And that is the same with DSP detractors: they would never watch Phil, they just wan t to see some dumb takes

Now that Doody is back to being an illegal clip stealer who should be stopped... is this the quickest turnaround ever? Just yesterday, or two days ago, we were very adamant that no one should do anything to him and that it's all allowed and transformative.

Just goes to show what a giant bitch coward DSP is. He never says what he really thinks, unless he feels like he has the upper hand (now Keem is in his corner, so he feels more confident). All detractors should be in prison for stealing his amazing KHANTENT!
