Because he's "of counsel" and non-resident, so likely it's just an associational thing where he gets to represent himself as part of the firm but is not an employee or shareholder, but rather an independent contractor. His solo practice is still active in TX. (I'm not screenshotting or archiving anything in this comment bc it doesn't seem that important, but you can look up Haygood Law Firm here.)

Given his evident implosion by/around 2023, I'm guessing this is intended as a mutually beneficial arrangement but with very low risk on the part of the firm in particular.

This is a good catch. "Of counsel" can sometimes mean "elder statesman who doesn't want to do the partner grind but lends his advice/name to things", but it almost always means "NOT one of our actual lawyers".

Given the topic at hand (internet drama lolsuits), it may be an arrangement where the firm lets him take the unseemly cases they don't want to be associated with. Like Touchstone Pictures handling the R-rated stuff Disney didn't want under its main brand.
