Re-reading Nick's motion, they only reference the clip in the powerpoint video and don't bring up the full 4 hour video they were given. The clip in the powerpoint is the one they point out is from Cog's channel. So you're probably right, if the full 4 hour video had been snagged from Cog's channel, they'd have called it out in their motion.
It was brought up in thread above, but the logo they were showing is a channel logo that isn't embedded into the video (it's some sort of still image overlay in the browser). So they either screen recorded the video off of Cog's channel for whatever was referenced, or they were doing it for snippets and screenshots in the summary.

Again, I don't think it's relevant. Cog is too lazy to doctor a video, and they didn't prove there were any substantive alterations.

Not likely worth the bother; countering with facts makes the point. But it's a bad look.
 
Any "DA" or representative you hear talking about responses to suppression of evidence or motions in limine are lying and don't know what they're talking about.

Nick's response will just need to cite a few more unrelated cases and there's no way that the judge doesn't grant his motion (to not suppress any evidence).

Would've probably had a differed prosecution of some sorts and not even have it on their records.

Such fucking loser talk. When the government plants evidence in your house, pays off lab technicians and runs a campaign of harassment targeting you AND YOUR FAMILY, you don't just roll over and take it. You have to fight, loudly and publicly. That's the only way to beat these fuckers. You have to drag them into the light so the world can see their corruption and evil first hand. There's literally ZERO admissible evidence that Nick did any wrongdoing, and the state's incompetence and wanton disregard for even the most basic legal groundwork will be their undoing. By my estimation, Nick is only about 5 (possibly 6, because this judge is clearly as biased and jealous of Nick as the cops and DA are) legal filings from being a free man.

So the State (super evil government defending Joe Biden) looked at the video on his channel and told him they did. That must have leaked out of one of his brain holes. It's not like they can't ask Youtube to just give them the video right? I don't know for sure but I'm pretty sure youtube saves everything.

I have to say, I'm pretty impressed by this small town police department. It's like they saw a bunch of starving kids with dirty clothes living in a house with a mountain of cocaine and decided to do everything they could to nail Rackets to the cross. Must be a conspiracy. That's so WEIRD!
 
The reply brief does not address White's novel argument that the police were required to obtain a warrant for the firearms even if they were plainly evidence of crime because it would have been easy to do. Probably because it is stupid.
The authority to seize the guns was clearly established in the state's argument, and ease of extending the warrant isn't in the relevant statutes or case laws. So the argument is irrelevant, which I would agree makes it stupid.

Actually it seems the argument is drugs = guns = crime in and of itself.

When law enforcement found the firearms, it was immediately apparent that they were evidence of a crime. In Minnesota, it is unlawful for a user of controlled substances to possess a firearm. Also located in the home was over 26 grams of cocaine, a Schedule II controlled substance, and 8 dosage units of Ketamine, a Schedule III controlled substance. There was evidence of use of these controlled substances also in the home.
