I agree with the spirit of fighting it. But its Minnesota. I would really advise him to carefully consider the upside and downside of fighting a charge like that. Talk it through carefully with an attorney. Charging him with the two counts means that they intend to get him one way or the other even if he were to prevail on the worse charge. He might fight and win on the whole issue of "harassment" (and the worse change) but then they would probably throw the book at him on the lesser charge.

You are dealing with the warped world of Minnesota law and morality here. Part of the game there is that lesser crimes are often punished worse than greater crimes.

In my personal opinion, Aaron actually needs to fight against this hard. The fact that they're charging him at a felony level means he needs to do everything possible to get that felony dropped. Because he also got tagged with a misdemeanor conviction this year, he further needs to fight because it's likely that if convicted even at only the misdemeanor level that he'll see some jail time.

To be honest, I think this is a severe miscalculation from Nick. I do not think Kayla has the actual wherewithal to take this to trial and testify about all the embarrassing details from the Qover, especially because the rumor right now seems to be that Nick pushed her to do it. Further, I think there are going to be a lot of issues with the State's case generally that will make this annoying to prosecute, especially at the felony level. The likelihood of Aaron seeing an actual conviction or punishment I think is relatively low provided he actually fights it out, but the chances of more salacious, embarrassing details coming out about the Rekietas (and other witnesses) will be high.

Nick will regret this in the end, I bet.
