Deleting it doesn't mean that it's gone. Either his phone, Aaron's, or possibly even one of their cell providers might still have a copy that the cops are able to access, either by forensically imaging the phones and running them through data extraction software designed for phones, or by subpoenaing either/both of their cell providers.

Whether the cell providers would have it depends mainly on whether they bother storing copies of MMS, or if they just archive the message text. Storage is cheap though.

They didn't even have a warrant to take his phone. If he brought it to jail voluntarily, though, and still had anything of Kayla's on it, he is a fucking idiot. It could still have been in his conversation with Geno on Aaron's phone.

They still have an issue if Aaron has any other photos on his phone that show Kayla's tattoo. In the on-air exchange, neither Aaron nor Geno says that the image sent is a nude. The only people who can confirm it being a nude are Geno and Keanu and it's not certain they will play ball and testify. What they have said while not under oath isn't especially useful.
