I did not think that would be a possibility, but you could as well be right. Nothing in that record could be used against her unless it is for the same crime I believe. Something about admissibility.
"Youtube" is checked in discovery. Could literally streaming from the scene of the crime for her court appearance be used against her?
If she and NIck tried to lie her way out of the charge by pretending she does not live there, then yes it might be.
Remember, she was charged identical to Nick and Kayla, those were dropped and then a new charge filed for the coke and her credit card.
The case against April is fascinating to me. I don't really understand why she's being prosecuted here. It's a lot of time and effort to secure what will turn out to be a minor misdemeanor for possession.
Because she babbled on the scene and they want her testimony to make the case against Nick and Kayla ironclad.
Remember, she is also charged with a felony, not the same degree Nick and Kayla are, but a felony nonetheless.
I imagine they will offer her a deal to reduce the charge to a misdemeanor, give her a fine and require her to complete some out patient treatment program, and in return she will testify.

i'm not so sure. i don't buy that her testimony is necessary for nick's case, which is really, really straightforward. she doesn't need to "rat him out" or anything. the cops had a valid warrant and found an ounce of coke, other drugs, guns, and kids. he's fucked.

and she really should be too. she was living in a house full of drugs, guns, and children, and there's lots of evidence to show that. my best guess is that nick, april, and kayla flat out lied to the cops about april just visiting at first and the cops bought it. once they learned about how deep the relationship is and that she really does live there, then of course she's on the hook for possession.

the bigger wildcard i think is when they establish that she was living there if they will also tack on additional charges regarding the kids, especially if she was ostensibly their nanny. that seems like a fairly easy case for the state to make. so the thinking might be if she pleas guilty to just the drugs (felony possession), things might not get worse.
 
I think Balldo is keeping in contact with Nate for two reasons.

1. Nate has a big audience.
2. Nate's first video on the Frank's hearing was very generic and avoided addressing the weaknesses of the claims.

He is keeping in contact with Nate because Nate is a black man and Nick fetishizes black men.

My theory re: April is that when Nicks case got so much press and so many eyes were on it, it was a really bad look to let April get away scott free when she was doing the exact same stuff. What kind of message does it send that they just pick and choose who to prosecute for the exact same drug crime?
I have an even simpler explanation. Cops were hoping she would cooperate, she didn't and now she is also in trouble.

The bodycam footage is in evidence and if they want to play the part where April talks to the cops (where the KiwiKouchKouncil assumed she spilled it all) they will have to call her as a witness so non-praticing lawyer Lord Balldo and non-competent lawyer White can cross her on the stand.

And tbh, why would you not slam all the evidence in their faces? If you got footage of a 3rd person who was in the house talking to the cops and throwing the Crackietas under the bus I would absolutely 100% play that for a jury. Not doing it would be borderline malpractice. It is such a strong piece of evidence for a jury trial.

Instead of dry police reports and officers talking about the search you get a young blonde woman on the stand getting crossed by the state and defense over her role and what she said. Much more entertaining for a jury and at the same time corroboration of what police found by another party.

She had ample chance to just disappear - with the initial confusion about whether she was or wasn’t living there, and the charges being dropped, that was the time to quietly get out of dodge.
Nick is obviously to blame - he must have insisted she stick around so he could defend her. Plus having ruined her marriage she didn’t have anywhere to go.
She told Aaron that she would never leave Nick
 
I am now half convinced that the Franks thing was Nick's idea. The client gets a lot of say in the legal strategy used by their lawyer, and I am now starting to theorize that Nick may have exercised that control. The Barneswalker slipped in a lot of different things inside his Franks argument, like a motion to suppress evidence and a few other motions, but at the end of the day he had to argue what Nick wanted him to argue. With Nick going on stream and talking about how he won a Franks hearing in the past (he didn't, but he did get the chance to have a Franks hearing), I wonder if Nick walked into his office and said, "You need to make a Franks challenge."
If the lawyer is a spinless fuck. Competent attorneys will listen to their clients but ultimately make the decisions about strategy.

Nate and Kurt both said this was a two witness case: The cop and the forensics guy confirming the drugs. Anything else is bonus and quite frankly between the tests and the bodycam footage you do not need anybody else. I would even argue that putting April up on the stand could potentially backfire on the prosecution and cause problems. I'm not even sure I'd want Aaron up there, either. Show the youtube video of him jacking it with white powder on his nose and then show the bodycam footage and that'll end it right there and then.
