Sean noted Trump's interlocutory appeal based on invoking presidential immunity in that stream. I'll note I went into why specifically an immunity argument is often entitled to interlocutory review, because an immunity argument is not a defense. It is an immunity even to have to stand trial. Therefore, it gets reviewed much more often because even having to stand trial at all is what an immunity gets you.

If the judge makes an error on a decision like this, it is not correctable on appeal because the harm has already been done and can't be undone.

I'll note this is why the appeals court in the Monty case actually did choose to take up the interlocutory appeal in that case, even though Nick ultimately did not win it.

By comparison, this is a routine evidentiary decision. There is literally nothing at all unusual about it. It presents no unique issues. Nick might still win the case. And if he loses, or takes something similar to a conditional plea (another issue I've discussed but while Minnesota doesn't have that exact mechanism it has a similar one), the evidentiary issue can be taken up on appeal.

There's literally no reason whatsoever to review this now. I mean Nick may feel he's a Very Special Boy who deserves an exception to the usual rule, but he isn't, and nobody else agrees with that.
