I don't know about Nick's explanation but it might be interesting to hear April's explanation if the state decided to upgrade charges. There's plenty of public info now to discredit any nanny theory and to discredit the claim she's not living there, douche in the for-sale house notwithstanding.

Whether or not April is living at the house now isn't relevant to the criminal charges (CPS might care, though). It's whether she was living at the house when the search took place which matters in respect of the criminal charges because her charges can be upgraded if it can be proven she was.

More or less everyone who has looked at this from a guidelines sentencing POV have concluded it's unlikely, but Nick is really pushing the boundaries, almost as if he's trying to speedrun what justifies an upward deviation. Nothing he's charged with would ordinarily result in such a sentence.

Courts are often reluctant to do upward deviations because of the difficulty of justifying them and the opportunities for appeal. Upward deviations generally require factual findings, on the record, in a trial or at least an evidentiary hearing. The finder of fact, which is the jury or the judge in a bench trial, have to find facts that support that (after Booker/Apprendi and the huge revision in the use of sentencing guidelines mandated by those cases).

If Nick were actually trying to make a case justifying deviating upwards from sentencing guidelines, he would be the world champ of it.

It's a stupid flex because even if the story about the dancer being pregnant were true, it wouldn't be at all natural for Nick to assume it was his because she was probably having sex with many different customers on a regular basis.

Resorts in general are a hotbed of sex between staff and customers, regardless of the rules, and it's going to be 100 times worse at a resort built purely to facilitate casual sex.

Went back to the timeline that @House Cat made and checked the stream that Nick did on April's previous court appearance. It is definitely a new stream, this isn't old footage in a gayop. Maybe I was being overly paranoid but with all the shit around this just wanted to make sure that dabbleverse people weren't trying to make up stuff using old footage. Screenshot of the old video is attached, clearly April has a different hairstyle even if she looks to be wearing the same jacket.

So basically it is confirmed that April is still with Nick, and is still at his house. This makes it more likely in my opinion that Kayla has been evicted from the polycule.

EDIT: Since the leaked DMs with Kalea yesterday I am convinced that Nick wants people to know April is still with him. He knew people would be watching the hearing, and I wouldn't be surprised if he wanted April to NOT attend in person, and attend on zoom, just so he could "show off" that April is still with him. This is Nick's way of showing that he is in control of the situation and that he is showing off his sexual side piece.
