I miss smug Aaron from right after the arrest. He was courting all the bullshit that came his way and anyone with two braincells to rub together saw it coming as well. He was caught in Nick's shitweb, all the while thinking he was the spider. I'm sure finally making above minimum wage on his "show" helped blind him. That wasn't light at the end of the tunnel, bud. That was a freight train you were too stupid and arrogant to recognize.

The wild part is that despite getting in a coke driven cuckfest with Nick the Nose, he's been smart enough to start extracting himself after getting slapped across the face a few times. The overwhelming majority of cows don't. He's just some random schlub who got mixed up with stuff above his paygrade Aaron can't hang with the big dogs. Hopefully he does right by his kids and makes sure Patrick get's what's coming to him.

Probably. The way I read the statute I assumed they wanted an upgrade to felony to be able to come easily. If you read the initial charging decision, the cop(I think) seems to have interpreted harassment as an ongoing thing to be claimed. I think the statute is more literal. So, say I sent a naked pic of an ex to her father and said "she likes it dirty". That's still sending to 1 person and therefore misdemeanor, but I have then sent it to someone in order to punish the ex in some way. The intent behind sending. Felony upgrade.

That does seem what the case law says as well. The literal case of misdemeanor is exactly what Aaron did. I'd guess it is very very rare that someone sends a single picture to a single person and the victim finds out.

In Aaron's case it seems obvious he never intended it getting back to Kayla. It took Geno, whom hadn't met or spoken to Kayla, telling Keanu and Keanu, who also hadnt met or spoke to her, being a super snitch for her to even find out. So I'd say it fails that definition of harassment.

The other definition, which the initial cop seemed to try and use, but seemed to have the language modified later, took it as a campaign of behavior type situation. In that case, in my mind, unless you had enough to charge Aaron with harassment prior to the picture being sent, it can't be criminal harassment. Talking about how you banged someone isn't harassment, even if the other person finds it embarrassing.

So I'd say the harassment upgrade fails on any definition and I really don't see how the prosecutor can be confident on it holding up.

That's not to say I agree with what Aaron did. Just that the upgrade to felony seems bullshit. Plus the seethe from Nick will be legendary if dropped.

Someone will have to take this to the Minnesota Supreme Court and get that bullshit declared unconstitutional.
Because they can declare something to be harassment that does not even get close to matching the actual legal definition of harassment under Minnesota law.

It is absurd how broad this law is and the freedom it allows police and prosecutors when it comes to overcharging someone with a felony, even if the accused did not do anything that comes even close to harassment.
