So it's pretty likely that Nina is being held with women because he legally had his gender changed, right? If this is the case, they should have zero basis to request a transfer, since they can't claim his status as trans has any relevance at all, right?

I don't think we have any reliable information on how easy or difficult it is to get transferred to a facility closer to family. Asylum claims tend to take a long time, so it might be possible - but Nina would have to clear the first hurdle of establishing she fears returning to India. As that's not likely to fly, and she doesn't really have any options for appeal, then ICE might go for rapid removal.

If she's only going to be detained in the US for a short time before being deported, it's harder to argue in favour of a transfer - especially when their "business" is operated remotely and doesn't require Greta being anywhere in particular. There's literally no reason why Greta can't sleep in the RV in Arizona for however long this takes to play out. It's not ICE's problem that they were just about to move back to California and Nina being in Santa Ana would be more convenient for Greta.

Obviously they're hoping that a Cali immigration judge will be more lenient than an Arizona immigration judge.

I thought the narrative they were going for was that Eloy was dangerous because of Nina's trans status anyway, but here's the thing: Greta has claimed to have talked to Nina through a phone call once, right? maybe it was before the transfer, but Greta would absolutely be REEEing right now that Nina is being criminally endangered by being kept with men if that was indeed the case. Because we haven't heard anything, it makes me think Nina is in no danger of sexual assault from evil cis men, unless they're too afraid to say anything because it would be accusational towards fellow illegals - but I doubt it.

Greta saying that the error in the M or F on the passport is just adjusting the story to fit the tranny prosecution narrative. He probably freaked out and that's when the BP made remarks about gender, if they did at all. But we won't know what happened at those destined cross roads until the court date. But we know this: it's fucking hilarious and Greta deserves this.

Nina will try to get credible fear. If she is denied she can try to appeal, but that's incredibly difficult. Once credible fear is denied then push is on to rapidly deport - and they can act fast. If she gets credible fear then she will have to petition for bail, which given her history will be an uphill battle. (Anyone interested in the asylum credible fear process should watch an excellent documentary called "Credible Fear" for a great look at the process and interviews.)

ICE doesn't "transfer" people to make things for more convenient for anyone, ever. All they would be dealing with is people requesting to get transferred to "better" or nicer facilities if that was possible. You are stuck in the ICE facility you are taken to until you are either bailed out or deported. (Maybe, if her asylum claim drags out for years she might get transferred but not because she requested it but because they needed to make room for others, and another facility had open beds for long termers.)

Besides they don't want to complain about "business" given that Nina is illegally working for TLL. ICE doesn't give two shits about what TLL's or Greta's business needs are. Nina doing work for TLL is a big black mark on her attempt to stay here, not something they want to keep bragging about.

Immigration judges are more lenient in Northern California and on the North East Coast. They are harshest in the South and Texas/Arizona. (They keep stats on the number of denied/approved asylum claims. I just remember the stats from years ago)
Old Nina is in a bad spot, cause she will be going to immigration court right in good old, over crowded, Elroy, AZ. Not good. If she somehow manages to get credible fear AND gets bail, she can request her case be transferred to immigration court in Chicago, (they will give you the court closest to your registered legal address so travel for court appearances is easier) but that's a far off possibility for now.

That's pretty funny because they'd have to trek across the country to attend court.

They always try to use the most sympathetic picture of the subject. Remember how the media used Trayvon Martin's 3rd grade class picture instead of the recent social media pictures of him pointing guns and holding bags of weed?
