One of the names being floated around on the Trans Lifeline twitter page as their new immigration attorney is Ava Banech

Based out of DC, she's a LGBT immigration lawyer who does a lot of pro-bono work.

OMFG, Greta has now given us and the world the name of their lawyer so she can be inundated with complaints about these two? And after all the grief she has justifiably incurred from Kiwi Farms and aggrieved parties! She has zero impulse control and a refusal/inability to learn from negative experiences, and these are defining features of lolcows. Greta is a fucking moron of the highest caliber and so is Nina. Oh, well, lots of fun for us at least.

The only thing I can imagine is she's either a complete idiot who believes trannies are exempt from the law or, once again, Greta is lying to get special treatment because this case is becoming unwinnable.

Or Ava really is their lawyer and is not an insufferable simpleton like her client is. What an awful lot of Kiwis fail to realize is, it's very difficult to effectively convey information to strangers, and Greta and Nina superficially are very sympathetic figures. The average person is going to feel badly when they hear of a couple who founded and run a transgender suicide line being caught up in this, especially if they also do LGBT work. The average person is not going to be easily informed of the extremely damning evidence KF has unearthed and archived. Null has a hard enough time trying to promulgate information to his own userbase. A lawyer isn't going to do a Google or Kiwi Farms search on some trans client who comes to her, and ultimately it wouldn't matter even if she did unless she's doing this work pro bono.

Of course, if that is their lawyer and the lawyer is as retarded and shrieking as the client, this will become even more entertaining.

You guys have no concept of how to deal with things you don't like and that is absolutely fascinating considering what sort of a forum this is. I don't know how we ended up with a population that is 50% transgender/lgbt-"ally", but it has slowly rotted away at what the very notion of a lolcow is. We've become Imgur-lite, a shitty, reactionary website filled with easily offended prudes who can't even stomach something they don't like being on the same domain name as where they post.

You people are so fucking easy to troll, all one has to do is make an alt account and say something disagreeable to end up with a 400 reply thread in under 12 hours. This has happened numerous times. Introman isn't here to troll, but he knows how preposterously easy it is to offend the LGBT community. He's a contributor to RoK, a troll website, which is the parent company that owns Reaxxion, also a troll website. I've said this multiple fucking times and nobody believes it because you'd all rather cry about dumb shit.

It might be a case of simply trying to soften the blow - maybe she can't win the case, but she can get Nina transferred or something. Regardless of whether the case is winnable or not, having an actual lawyer on side is far smarter than relying on Greta's peanut gallery screeching all over Facebook.

@Manapan should be crowned Anti-Lolcow of 2016. This is absolutely enthralling to watch. Though the story behind her efforts is really tragic and I sympathize with her.
What I particularly like is that nobody seems to be able to directly address the criticisms beyond "uh the line is understaffed cant blame them." They can't respond to the question of what happened to the green card money or why Greta thinks it's okay to victim-blame a widow. They've steamed in with this absolute belief in the rightness of their cause, that it's racism and transphobia and Grina are the good guys and ICE are literally Hitler. When presented with the idea that maybe it's not a black-and-white issue, and evidence that Greta is not the saint they imagine, they're completely lost.

If Greta, Nina and friends are the lolcows, I guess that makes Manapan the lolmilkmaid.

Ava's lawyer seems to spend a lot more time on the immigration policy spotlight rather than down in the trenches. She also went to the lowest ranked law school in the country that basically lets anyone in. However, she has practiced immigration law and specializes in people in deportation proceedings which is what Nina needs. The fact she is in D.C. is very bad for Nina. Hiring a lawyer that lives 2,000 miles away is not going to do her a lot of good for the moment. They are going to have the fundraise a lot of money because old lawyer will have to fly out to AZ for any appearances with El Nino. (They do however do some "tele-apperances" but that's usually for the judges and the clients in remote detention so they don't have to bother trucking them all to a courtroom.)

I'm not going to give any pointers to Greta but hiring a lawyer on the other side of the country is a dumb ass move any way you look at it. The fact that Greta is still chimping out online and doing her utmost to help Nina get deported makes me think she hasn't spoken much to this lawyer OR the lawyer acts like a lot of immigration attorneys and keeps them in the dark. Information is power and immigration lawyers spent years learning the complex maze of immigration laws, some like to act more like wizards and not explain or clarify anything unless they are forced too. It keeps their clients ignorant, scared and paying. The type of immigration law she specializes in means she deals with shit being dragged out and is probably aces at false hopes to keep the money rolling in.

Nina doesn't have a lot of hope at this point. Asylum is the only option remaining to her for staying and I did a bit of research. The USA only granted 3.2% of ALL asylum claims from Indian nationals in 2013 -- and that number includes the bleeding heart judges in San Fran and other cities that approved 80% of asylum claims in front of them. That's a VERY low number. Add to that the fact the ones that are approved seem to all come from Sikhs fleeing religious persecution. I don't think Nina is Sikh or religious.

Playing the transgender card is her only option and holy fuck is she going to regret that interview she did on the subject of transgender people in India. Keep in mind just proving that transgender people are discriminated against or have it tough or her family will reject her doesn't mean jack shit. She has meet the legal standard of persecution that endangers her life/freedom and that the India govt does nothing to address or protect her -- oh the irony of this situation. People that have been screeching about being misgendered online being literal rape are going to get a really hard legal lesson in what governments consider real persecution - and the USA sets that bar high.
 
Articles like the one on medium don't even count as articles. They just copy and paste literally what Greta is also copying and pasting over and over sometimes with the same email links to ICE. And all the 'authors' in some capacity know her. I think only one article had a 'I know Nina personally and...' section. It's like everybody is doing the least possible work on purpose. I'll also add some information since people seem to appreciate all my powerleveling on immigration. Nina is tackling an asylum from the most difficult and least successful way possible. If you do asylum the right way you come to this country legally and then (while here legally) request asylum. Some people get right off the plane and do it some wait, you have a year from entering the country to request it. The process is then pretty bureaucratic. NCIS conducts interviews, you submit evidence, they let you work legally while the process is ongoing, and they issue a decision. Only if they deny you, and you appeal, do you then ever see a judge in the matter.

However, Nina was picked up by ICE and then claimed asylum. She is facing an adversarial asylum claim meaning the government is going to fight you on it from day one aggressively, every step of the way. First step is trying to be granted "credible fear" which will be difficult for her. If she makes it past that step then a NCIS prosecutor will actively try to fight her asylum claim and the burden of proof is solely on her to prove persecution.

The USA does keep a list of countries that are recognized to engage in persecution and if you are from one of those countries it makes things a bit easier - India ain't on the list. Asylum is not "forever" either. I saw a case where a guy came from the former USSR and fled communist persecution. He was being deported back (after 25 years, paying taxes, owning a business with american employees and citizen children in college) because there was no longer any communist govt to fear. And he was deported, it was sad.

If she makes any false claims in her asylum petition and the govt. discovers it not only will she be deported she will have a lifetime ban from entering the USA ever again. Not that it matters, if she's deported it's guaranteed lifetime ban anyways.

The government has cracked down hard on economic migrants making false asylum claims because they clogged up the system so bad. India (and Mexico) and two countries that almost instantly get you viewed as an economic migrant. Add to the fact she came on a work visa, overstayed it and then worked illegally, she is pretty much the legal definition of a economic migrant. (Economic hardship or poverty does nothing for an asylum claim or we would have the entire third world living here. It's much better to prove you fled comfortable existence in your home country for difficulty here because that supports the idea of persecution and not economic reasons.)

Nina really is to blame for most of this. As an immigrant she had to know about the system and how it worked. Greta is a moron and (like many Americans) probably thought being married was like waving a magic wand and presto your safe and legal. Not even close. Being married to a citizen merely gives you an legal avenue to pursue a green card, it guarantees nothing. I'm sure they got married because Nina was getting booted from Google and they thought that would solve the problem. The fact that they didn't have an I-190 and adjustment status request in before her visa expired is so stupid it boggles the mind. You put that shit in the day after you get married, not fuck around for a year or two then look into it.
