As much people throw a fit about it most prisons have fewer jobs than prisoners, and most prisoners consider themselves lucky to have a job in prison because it beats being in lockdown and having money for the commissary makes life much more bearable.What about all the innocent White people in prison? The simplest way would be for Merchan or the appeals court to toss the whole fucking thing as the basis of filing felony charges was never proven in court. The alleged crimes are paperwork misdemeanors, save for the fact that Bragg argued they were committed in furtherance of a felony (a federal campaign finance felony), which under NY state law allows him to bump the misdemeanors up to felonies. Except, Trump was never even charged with, much less convicted of, that alleged campaign finance felony. It's a pure legal fiction. Trump was deliberately and maliciously mischarged, so it should all be tossed out with prejudiceJudge Merchan is in a real fix here. Either choice is going to look bad and lead to issues at the appeal stage.
I'm not familiar with New York law in specific, but under common law the standard for setting aside the jury verdict is based on a"no reasonable jury with the law and facts presented could have found them guilty" standard which is almost never used because cases that meet that kind of high standard get felted well before deliberation. So the question becomes why the fuck would the judge have allowed it to get to a verdict in the first place - and Merchan would have to explain his reasoning for all the very slanted rulings he made. (Like his jury instructions that ignored the Supreme Court's instruction and basically command the jury find Trump guilty.) If he doesn't walk a very fine line and turn his tongue silver, he could actually end up facing consequences beyond just the bad press. This is not the end, though, because BOTH sides can appeal this decision, and would be motivated to do so - Bragg would like to keep his conviction, and Trump would like to show the whole thing was unlawful. More on that below.
Option two, he tries to sentence Trump. If he gives Trump no time, then it again confirms this was a political hit job and fuels future purges, while probably setting Merchan up to get whacked by some insane Antifa loon. If he tries to sentence Trump to jail, that unleashes a shitstorm that will keep Trump from being incarcerated - at the very least pending appeal, because:
1. Trump will ask for, and be granted a stay when the defendant is likely to succeed at appeal and also
2. Trump would further move for a suspension of his sentence or outright quash as being in prison would interfere with the Federal office to which he has ascended. Due to the hierarchical structure of the government, the Federal level interests trumps State authority, and in this case a State's interest in keeping the now President locked up for paperwork crimes cannot possibly outweigh the national, Federal interest in having a President that can freely travel and execute the duties of the office to which they have been elected by the nation. This is the basic underlying logic behind such ideas as 'you can't indict a sitting president' you might have heard before.
Which brings us to the shitshow that will be the appeal to the New York Court, which will be a brutal filing that is going to tear the trial judge apart for massive amounts of reversible error. (Not just on immunity, there are a lot of other issues but immunity is the biggest one since the SC made a ruling about it.) Its going to bring an incredible amount of scrutiny down on the judge, and put the appeals court in a real Morton's Fork. None of their options are good.
1. They dismiss the case as being improperly brought due to immunity issues, which is going to make them and Merchan look like fucking morons for not staying proceedings until the Supreme Court gave guidance. The Appeals Court even had the chance to intervene, and declined, so its egg on their face as well.
2. They send it back to be retried and in the course make the trial judge look like a total dipshit asshole as well as themselves since they denied all interlocutory appeals. Trying to actually move this case forward under the Supreme Court's guidance would be practically impossible, but if they order it be done its going to be another shitshow that will generate tons of political capital....for Trump.
3. Or they rubber stamp the entire affair and send to the Supreme Court, who will be extremely pissed off that they have to waste their time dealing with the bullshit caused by multiple lower judges ignoring the SC's opinion.
There may be a way, theoretically, to thread the needle and somehow charge a President for a set of criminal actions that started before his Presidency and continued into it. (Hard to say, because the issue is so legally convoluted because the Supremes were trying to deal with the sheer idiot levels involved.) I use the word theoretically with optimism, because even imagining the most brilliant legal mind presented with the clearest set of legal facts, would likely decide to simply not pursue any post-election charges just to avoid the issue as cleanly as possible. Why walk blindfolded into a yard full of rakes when you can just....not do that?
Instead of doing that, Bragg decided that he was going to charge for all the checks cut while Trump was in office. A risky move, but potentially salvageable if he just refused to touch anything close to the White House or the actual Presidency. The only problem is that at every stage he used White House material to make the case move forward. He brought official White House communications and depositions from staff to the Grand Jury just to get the indictments. At trial he called as witnesses more White House personnel to grill them about conversations in the White House during the Trump Presidential term. All kinds of testimony, documents, and other evidence that is absolutely verboten (by the Supreme's Opinion) is woven into the fabric of this entire case from start to present.
On top of that, the judge in the case was so eager to railroad Trump that he also ignored and actively downplayed the potential issues. At every step of the way, Trump's legal team was filing their objections and making the very reasonable request to delay proceedings until they had guidance from the Supreme Court. Not only did the judge deny these requests, he went so far as to scold the lawyers for making the objections - as if they were frivolous. The judge could have just put everything on hold until a framework was defined, but he barreled on through regardless and now is in a real shitty situation.
