Depends on the state. R&J laws also consider what protects somebody against sexual assault, and for protections against 'sexual performance by a child/engaging in simulated or actual sexual conduct'. Some states, like Texas, require that for the latter the age difference needs to be 2 or less, and the difference for the former is larger than that iirc.
