I disagree. It's difficult to value Twitter like you would any other company because their value is tied to an unquantifiable asset. Owning Twitter means owning the power to shape public perception on at least a short term basis. There's a lot of people on the planet that would value that power more than XYZ billion dollars if they could attain it. There's also the argument that it holds value as a weapon due to the role MySpace and Facebook played in toppling multiple governments during the Arab Spring..

It's not worth 40 billion to someone that is buying it as a financial investment with the hope of a return. It's potentially priceless to someone buying it for personal power. Like most things, it's just a tool, and the good or evil of it is exclusively tied to the person wielding it.

That's actually pretty funny. Not actually true, though, it's obvious Trump views Musk as a clown and was even mocking him openly not too long ago for what a sycophant he was. Trump would have won without Musk's endorsement and dancing around like an autistic spastic trying to physically turn himself into an X.

He's big mad that Elon is forcing all X arbitration through Texas courts.
That's not an arbitration clause, it's a choice of law and choice of forum provision.
The laws of the State of Texas, excluding its choice of law provisions, will govern these Terms and any dispute that arises between you and us, notwithstanding any other agreement between you and us to the contrary. All disputes related to these Terms or the Services, including without limitation disputes related to or arising from other users’ and third parties’ use of the Services and any Content made available by other users and third parties on the Services, will be brought exclusively in the U.S. District Court for the Northern District of Texas or state courts located in Tarrant County, Texas, United States, and you consent to personal jurisdiction in those forums and waive any objection as to inconvenient forum.
This is nowhere near as bad as a forced arbitration clause.

Bluesky exodus is hilarious.

So a lot of the artists have just realised they were duped because you can still opt out of AI training and they haven't been forced to allow their data to be used on training.

In fact, I'd argue the artists who jumped ship from Xitter to Bluesky actually kinda fucked themselves over since Bluesky TOS doesn't actually have a provision to prevent their data being sold to AI firms and not only that, but they jumped to a platform which doesn't require login to view content, meaning anyone can scrape their art so much easier with a little bit of programming knowledge...

The politically inclined ones have went over due to the change in TOS and obviously it's going to collapse once they realise that they've created a box of many really annoying people. The purity spiralling will happen pretty quick.

But again, this seems to be a case where they've taken a worse deal by trying to leave Xitter and assuming that this new platform is going to be great and just work. Cause Bluesky TOS forces you through arbitration courts and restricts you from taking part in a class action, while I believe Xitter uses the state court system but just requires it to be done in the state of their choosing.

FWIW, they're probably doing it for business reasons and not due to any philosophical issues with the idea of arbitration.

Mass Arbitration Update: The Uncertain Path Ahead

If the incoming administration hamstrings the mass filing of arbitration claims somehow, maybe companies generally (not just Twitter) will reverse field. A set of slimy lawyers figured out how to use arbitration to hurt average consumers, and an equally slimy set of lawyers figured out how to use the provisions of the concept against the very same companies doing this. I voted for Drumpf but when it comes to things like consumer protection or unconscionable noncompete agreements, I find myself siding with the Dems, sigh. Like what I suspect would be the case here.

As a complete and total aside, I have a Bluesky account and I almost want to do this to see if it is real...

Not to mention it's not nearly as lively as they like to pretend it is. People with big followings that made the permanent leap will find themselves with a tenth of their audience if they're lucky.
