Go to any court room and you'll see that judges get PISSED when you violate bond.
Bossman violated bond, broke his probation AND while out on bond broke a protection order and attacked his dad again which led to more charges.

His ass is staying in jail until his hearing and then he better pray PRAY that the judge is in a forgiving mood when he is sentenced.

In front of the same Judge? Yeah no chance. Judges do not like defendants who violate bond or conditions. They generally view it as a personal affront to themselves and the court. Austin’s lawyer almost had a good response to this in pleading that Austin was suffering an untreated mental health crisis in rehab. But that was shattered as soon as the Prosecutor spoke up.

If Bossman had immediately contacted his lawyer and the PO managing his release, and simply said “they kicked me out, what do I do” he likely would have been fine. Bail would have been continued contingent on getting his ass into a psyche facility for evaluation.

But he didn’t do that. He went home and got high. Started his gambling again. Attacked his parents… again. violated the terms of the second bond. And when the cops showed up went for eluding them and resisting arrest.

Bail is to guarantee his appearance before the court and his good behavior while matters are before the court. Boseman just showed that it does neither for him. So it will be denied. The simplest way for the Judge to guarantee he shows up for trial and doesn’t get in any more trouble is to leave his ass in jail. Good luck finding any judge that would act differently. Our Kiwi Kourt Reporter described a brief conversation in the hallway between Bossman’s lawyer and the Prosecutor about bail which ended in a firm “No Chance”. At this point there is absolutely no reason for the Judge to grant bail again. Not even if or when Austin offers to “fuck his mother”. For much the same reason don’t expect to see a particularly generous plea offer of no jail time if he completes rehab, etc. He’s kinda already fucked that up. When all is said and done, he may get away with “time served” and conditions (which he will immediately violate, because Bossman) if he really behaves in jail, and ends up in there for 60 days or more.
 
I believe in a Derrick Christmas miracle. Austin just needs to write a letter how he's really sorry and he'll turn his life around and he'll make the most out of this one second chance if they allow him. Maybe add a statement about doing a happy dance for them if they let him go. We will be okay.
 
I had a dream last night that bossman was released. We were all there with him, and he won a million dollars on slots. Everyone was celebrating and dunking on rats.

I've never been psychic before, but here's hoping this was a vision of the future.
And presumably if you'd kept dreaming, bossman immediately bet and lost the million dollars right after that?

I've been meaning to contribute to this discussion ever since Austin's arrest and rehab stint for a bit now, and if someone has already covered this then I apologize. I of course have no personal knowledge of or experience with the Virginia criminal justice system specifically, but I can provide some insight into what could have happened with Austin if he didn't fuck up and get kicked out. The initial transfer of Austin from the detention center to a rehab facility was what is known as a "bed to bed transfer." You see bed to bed transfers a lot in cases involving defendants who have serious CDS-related addictions where relapse is a genuine concern (either due to the defendant's health or their propensity to relapse and reoffend prior to trial). In my state, a bed to bed transfer is generally indicative of one of two things. Either the defense is trying to get the defendant at least temporarily clean for the purposes of mitigation prior to entering a guilty plea to something like a CDS Possession charge, or the defense is looking at getting the defendant into drug court/problem-solving court/veterans' court (the name changes depending on where you are; in my state it can be all three, in Virginia I think it's just called "drug court"). I am guessing that Austin may have been looking at the latter option, since he would likely qualify for drug court in most states; he has a notable but relatively non-violent criminal history, he has a clear addiction problem, and he has probably never undergone serious intervention before.

Drug court is a lengthy process wherein a defendant will plead to something serious, take a big suspended sentence with supervised probation, and undergo court-supervised rehab and therapy for around 1.5 years. Assuming the defendant doesn't seriously fuck up and is able to get clean, the Court can modify the rest of the defendant's probation to unsupervised or even convert the conviction to a Probation Before Judgment (basically it no longer counts as a conviction). It is an intensive and demanding process but it's ideal in cases where a defendant's crimes are nearly all attributable to addiction and where a defendant is otherwise facing serious jail time.

A pre-trial release violation doesn't necessarily ruin Austin's chances of reaching a plea with the State, but no competent prosecutor would agree to admitting a defendant who has been kicked out of rehab into any kind of drug court program because if a defendant pulls that kind of stunt once, he'll probably do it again.

This is not the timeline nor what happened. Austin was granted bond (some say bail) and was released to go home awaiting his trial. Part of this was to do drug testing with pre-trial services/court services. Austin failed to show up for these tests and/or failed the tests themselves (same result).

When that occurred enough times, pre-trial services filed with the court that he was not in compliance with bond conditions, and the next time he went to the court house they locked him up. He actually knew this was happening and was on stream saying he'll just do some rehab and it'll be no big deal. He was already flaunting his drug use/non compliance and stating he'd just use his ace in the hole rehab to get out if he got busted.

After being locked up for i believe 5 days until the next hearing for a review of the bond violation, the defense offered up that Austin had a drug problem and needed help and thats why he failed his bond conditions. so could he pretty please go to this rehab. His father stated to the judge he already had a bed for him waiting at the rehab (which really was just a sober house). The judge then issued bond, ordering release to his father with orders to take him DIRECTLY to rehab. This wasnt a perfect "bed to bed transfer". Austin was not in custody but was back out on bond/bail with conditions to complete the rehab program. (He famously did not)

The offer of rehab was not to get Austin sober, but was to keep him out of jail on bond. Austin is super adverse to being in jail and will grasp at any straw to getout, but doesnt take it seriously, as we've seen. Yes, defenses would like to keep the "can we do some rehab?" bargaining chip in the plea deal, and drug court stages (VA just started drug court not too long ago). You'll even see defendants that get out on bond go straight to rehab anyway, to avoid the court order rehab and when they get to the judge it shows they were serious about getting help and already gotten it. Austin's defense had to throw that away just to get him back out on bond.

Had Austin still finished the rehab, I agree with you. But I think he's cooked any decent deals. He got kicked out of the rehab, violating the bond a second time. The judge was really pissed on that fact. TO top it off, Austin also picked up another domestic violence charge while out on this second bond where he got kicked out of rehab, and he picked up an eluding/obstruction charge and a resisting arrest (without force) charge. While being picked up for a second bond violation.

The judicial system doesnt try to fuck everyone over. But its true what they say, once you are ensnared in it, its hard to get back out because now you're under scrutiny and your bad decision making is no longer under the radar.

Austin would be an absolute idiot if he takes any drug court/deferred programs at this point as he's done so much time. He should just take the lump and go back to doing his crack as happy as can be. If he keeps trying to string out being on probation he's going to keep getting more and more time. Probation only works for people who want to change. There's no changing BossmanJack.
