Nick is doing is usual combination of telling a partial truth and lying at the same time. Right about now is NOT COINCIDENTIALLY just about exactly six months since the CPS process began. What has probably happened is that Nick and Kayla survived that six month hearing by having done everything that CPS requested. They don't lose custody of the children.

Contrary to Nick's REPEATED claims over time, his idea of this magic "CASE CLOSED" thing where CPS just disappears forever from his life and he doesn't have to do anything further for them is entirely a delusion. It never works like that. Especially if you have dragged through an entire six-month process right to the end. They will continue to watch and require. Its what they do. Its the whole nature of what CPS is. The consequences of non-compliance are less, but there isn't a "case closed" day.

He is telling the truth about that sword over his head though if the six-month process had gone wrong for him. His claim that he had "physical custody on a trial home visit" is also incredibly cynically and predictably Nick. The way to read that is that they did the first trial visit to the home with the kids in August. Nick had "physical custody" of the kids when they were in the house for a visit in August. He is just SO CLEVER.

I have an idea of what drug Nick might be doing that wouldn't be tested for. I think it's likely he's using something like Gabapentin. Gabapentin is sometimes prescribed for anxiety (Kayla could pretty likely have prescription for it) and for helping people get off alcohol (Nick could have a prescription for it). They're a good alternative to benzos because they are a good deal less addictive. Higher dosages are given commonly for seizures. At low doses (usually under 600mg, often given at 300mg) it helps reduce anxiety and can aid sleep. But Gabapentin has a moderate abuse potential because at the higher dosages you get alcohol-like effects.

I'm guessing that either Nick or Kayla (or both) has a prescription for 600mg twice a day, and Nick is slamming something like 2400mg (or more) at once. This would result in behaviour that looks very much like being drunk, while also allowing him to piss clean. If they tested for Gabapentin (which is rare) he could just say he has a prescription.

I won't bother doing a bunch of quoting here, but I agree with the kid testing positive being legit. They will retest an 8 year old. This isn't gonna be some shit where they just do one quick test and wing it. Nick claiming he wouldnt face more serious charges is bullshit, because it would be rolled into endangerment or something else. Why? You can't really prove how the kid got the drugs, but you can prove that it was a result of negligent parenting. Nick has a big fuckin mouth too so if there was another test and anything ever came back anything besides positive, he would be swearing up and down all over the place about it.

While hair tests taken after the initial test would have continued to read positive for some time, it's likely that subsequent testing was done using urine or saliva and you would expect those tests to read negative days after last exposure. Negative results would indicate that she stopped testing positive after removal from the home so they wouldn't be favourable for Nick.

Nick's only real hope would have been to have the original sample tested independently (the original sample is divided as a matter of course and the untested portion is retained for a period of time) or request that a new sample be taken and independently tested soon after the children were removed (this sample should also have been submitted to the original lab if their testing methods and results were going to be challenged). That he did neither speaks volumes.
