The Tennessee DA dropped the charges due to Davey moving away. Wasn't much point in prosecuting a minor drug implement charge on a out of state person.

If you run the last name "Muscato" through the Missouri court system as hosted by case.net you can find every member of the Muscato family stretching all the way back to the 1980's.

Dave's parking ticket and name change both show up. Also his father's previous cases of "Unlawful Detainer" against him going all the way back to 2012. For some reason his father requested a copy of his name change case in 2020.

Dave actually has entries under 3 different names. The cases his parents filed against him for the restraining orders is there, as well as a very interesting entry for 2007 where Dave sued someone in small claims court, a Ms. Amie Jo Gunn. She never appeared, so Dave got a default judgement of $1.000, and actually went after her Employer for a garnishment. I would love to hear what she has to say about Dave.

There is a weird case filed against his brother Jeff in 1999 on behalf of a minor plaintiff involving a personal injury claim. My best guess is car accident with the child of the person involved in the accident claiming injury?

Interestingly the Dr's Muscato filed a case against the curators of the University of Missouri back in 2017 for "Property Damage" but then asked for the case to be dismissed with prejudice. Not sure what happened in that situation.

Both Dr's Muscato have been sued once each by different patients, both suits went nowhere with the one against Dr. Joe's being dismissed for failure to prosecute, and Dr. Mary's being dismissed by all agreed parties, which I would imagine meant settlement.

He has 3 brothers, right? His twin Andy, his other brother Jeff, and then Mark, right? If I remember correctly. If so, then his brother Mark is actually going after Monsanto in a personal injury case. Filed this year in March, and it is ongoing.

You guys realize this will probably be at least two full days if it's set for a jury trial, right? It's basically impossible to do a one day jury trial unless this judge is fucking speed racer at impaneling a jury. The fact that he has the number 5 after his initials in the trial setting order makes me suspect it's set for five days, but I wouldn't guess more than 3.

If somebody goes to the pre trial listen for any talk about expert witnesses. The only possible justification I can think of for that length is they're going to try and make some complicated mental state defense with medical testimony.

Columbia is a college town but those people aren't in the jury pool, largely. The average mid-Missourian would have probably been far more hot headed than the Dr.s Moscato, and I don't think you'll be able to convince them that the sign shit isn't harassment, at the least.

I forgot to mention that only one malpractice lawsuit personally naming them apiece between the 1980's and when they retired (which likely covers most, if not all of their medical career) is fantastic, especially when you consider only one was likely settled, and the other was dismissed. This speaks to the incredible level of care that the Dr's Muscato provided as oncologists to the Columbia, Missouri community and how they were viewed by the community. I can tell you that from published studies on the subject, just being as asshole as a doctor drastically increases your risk of being sued, even if they are just nuisance suits (malpractice suits with absolutely no merit and are just an attempt at a quick payout).

Just based on this alone, I wouldn't have hesitated to have either one of them as my treating physician, or the treating physician of my family (and I am extremely picky).

If this really does go to trial, I'm expecting quite a show. Dave will try to testify to his parents' supposed abuse, which has nothing to do with the charges against him. If his lawyer can't convince him to shut up, the judge will be smacking him down.

Dave is such a liar that he will probably say something that is verifiably untrue, adding perjury to his crimes (not that they'd bother prosecuting that).

Finally, how many jurors out of 12 will be unable to repress their disgust at this gross, fake imitation of a woman?

You should note that the Boone County Courthouse does not allow you to bring in any sort of recording device, not even your cell phone. I will be bringing pen and paper, and I suggest you do the same. If this becomes a multi-day ordeal, will you be still able to attend?

I've seen Dave around a few times. Dave has clung to his word -- every time I see him, he is wearing his Black Lives Matter hoodie, like some sort of humiliation ritual. Dave doesn't appear to be all that fat these days, he has slimmed down, but the most striking thing about him, other than the stupid fucking guitar on his back or his cat which he carries everywhere, is just how dirty he looks. He looks unwashed, homeless, gross. He constantly looks around like he's in danger.

He's a terrible improvisatory guitarist. He can't find a motif or repeating riff to structure improvisation around to save his fucking life. I actually think there's a tiny grain of truth to the idea that Joe Muscato (think mob boss) is using his nefarious connections to persecute his innocent fragile daughter.

Joe is a well respected member of the community with a son on the police force, and Dave has been openly and publicly harassing both his dad and his cop brother. It varies from district to district, but DA's often have a bit of latitude regarding which cases to bring to trial, and I can see why they might be motivated to spend resources bringing it to trial just to shut Dave up.

It's not especially conspiratorial. It'd be moreso the cop brother making sure that the officer taking his dad's statement isn't a total dumbass, and maybe schmoozing with the DA to emphasise how much of a clearly unhinged menace Dave is, and how it would be a huge favour if the DA could find the time to get the case on the docket.

I can definitely make the pre-trial hearing on Monday, not sure about the trial. I have finals on the day before and after and I don't think I'll be able to spare more than a few hours, so if it's multiple days I definitely can't do it. I'm glad I'm not the only local Kiwi to document what's happening, hats off to you sir.
