Side note: this sounds way more realistic in terms of fairness in evaluating asylum claims. While I'm rooting for the shitstain to get deported my primary concern is about TLL's failure to take calls and save lives. The research continues.

That was a huge find sir, you're the real MVP. Considering though that her case is a last-resort asylum claim I guess we can safely say it falls a little short of the 50% chance, considering that probably most of these cases are people who aren't total fuckups regarding their papers like Niraj is and he's also asking for asylum from a country that clearly isn't islamic enough to be throwing their transpeople out the window in their sleep. So all in all it would be safe to assume chances are skewed in favor of him going back to his designated streets in India, even if not by a huge margin?

Also I asked before if there was any chance of him trying to stall the case long enough so he could get a green card through other agencies. Anyone knows if that's a real possibility?

I don't think the federal court will play ball like this. They're going to send Pajeet a summons for a date where the case fits in and if he's not there the judge will by default issue a deportation order.

You're downplaying the power of attorneys to stall a case. This has been mentioned multiple times so far, I just want to know if his green card would be automatically denied or postponed considering he has an immigration case pending if he tries to go for one.

Alas I hope you're right and that justice is swift but I find it optimistic. People have mentioned this entire ordeal taking years to come to conclusion and I find that pretty reasonable considering the usual pacing of legal proceedings.

There's no need to find it optimistic. It will take years if Pajeet plays by the rules.

If, for some reason, he thinks they can get the dates moved and just doesn't show without having a good reasson then the immigration judge will issue a deportation order. There is no two ways about it. You can then petition for a stay of deportation and hope the case gets reopened, but if you didn't have a good reason for not following the direction of the court you're fucked.

I think he means we'll get the continuance after continuance thing pending whatever other things Nina tries.

Also I wouldn't read too much into the varying approval rates, except in the same venue (like this Judge DOOMarzio guy who sounds like a real hardass). It may be this venue just gets more legitimate asylum claims. Compare to the court with much lower rates near Eloy. I'd bet a lot of their cases are just flat-out border hoppers from Central and South America.

This also isn't necessarily ultimate outcomes. A hardass judge with an absurdly biased decision rate is more likely to be corrected on appeal, for instance.

Also, if it turns out Chicago is actually a hyper-liberal sanctuary where the judges are biased in favor of asylum, that too would be corrected on appeal more often, and the feds can appeal a favorable decision.

fyi, SRS is legal and subsidized in Iran, where the government views it as a medical condition that needs to be treated. The usual American media suspects alternate between lauding this as yet another example where the US apparently falls short, and scratching their heads about how it could be possible in Iran (because they don't realize that sexual identity and sexual orientation are two different issues and that the "LGBT" umbrella is actually pretty misguided)
 
And besides, the toll on the people involved is still real, regardless of the outcome. I use "people" very loosely.

Dealing with the legal system ain't fun for anyone, and it's gonna put a strain on them, that's for sure. They will ree, they will rage.

She will have a master calendar hearing in Chicago so they can start scheduling all the various things needed to pursue a defensive asylum claim, including assigning a prosecutor to fight the case. Basically it will establish a timeline/deadlines for It still doesn't indicate whether she's had a CF interview or not, which is what I'm really curious about. I suppose the CF could be scheduled to take place in Chicago, but I'd be kind of surprised if that wasn't taken care of in Elroy before she got bail.

Anyway, if CF has been granted, he will attend his Master Calendar hearing in Chicago will be given a deadline to file the official asylum application and they will probably schedule the Individual Merits Hearing (even though that hearing date will probably be moved but they will pencil one in as a goal).

If the case is expedited it will take place in 2 to 6 months, if its not expedited it will take 1.5 to 4 years. You can request expedited hearings, or the Govt. may request it. I'm guessing they do not want it to be expedited and will run the clock. Expedited cases are generally only for or requested by people in detention, to get the case adjudicated asap as to lessen the time spent rotting in detention.

If anyone is really curious about this process here is a great summary manual that outlines the process and goes into some detail.

One thing I found interesting in the above manual was this:

"As with an asylum claim based on past persecution, an applicant with an independent fear of future persecution is not eligible for asylum if she could avoid persecution by relocating to another part of her country of nationality, “if under all the circumstances it would be reasonable to expect the applicant to do so.” 8 C.F.R. §208.13(b)(2)(ii). If the persecutor is a government or is “government-sponsored,” it is presumed that internal relocation would not be reasonable. 8 C.F.R. § 208.13(b)(3)(ii)"

So basically Nina must prove, to a legal standard, that persecution will be her fate in all of India. Her pointing out some violence against tranny/gay people in this city or a law in on region in India doesn't mean shit if the prosecutor can show she could live without persecution in Mumbai or other large cities in India that seem pretty gay/trans friendly. It's akin to a black American who lives in NYC trying to claim asylum in Europe because of the KKK violence in Alabama.

Basically Nina has to prove that every inch of the entire giant democratic Nation of India is a bunch of tranny persecuting zealots that the govt. supports/does nothing to stop. Gonna be a real uphill battle, esp. since the entire reason she was in the USA was economic opportunity.

You could do this, be sure to include the Alien#, Name, DOB but it would be best to wait until we actually get the name of the prosecutor or judge assigned to the case - that's who this information needs to go to to make a impact. I do believe sending the specific relevant facts discussed earlier in the thread at ATTN: Prosecutor Name would be a very impactful and appreciated. You can't expect a prosecutor to try and sift through the mountain of shit currently online.

Only actual relevant facts, the info and statements directly from Nina and TLL, is all that's needed or should be sent. No bullshit, no opinions, etc*.. just actual print-offs of statements by Nina and from TLL about Nina's job/work with citation/sources included. But as long as you do it correctly and it's relevant it will be added to the case file. (If it's added to the case file Nina/Nina's lawyer will be given a copy of it too. lol)

(**Immigration gets plenty of BS from angry/axe to grind people who are mad at some immigrant and want them deported simply out of revenge. Real common among divorcing couples where one got a greencard due to marriage. So stick to only facts so they will review the information.)

Will the alien# be made public once the trial is set? Are these hearings open to the public?

There's no need to lie or make shit up about El Niño. All you have to do is print out copies of his slate interview and others. Also, include comments from Facebook, proof that he's listed as an owner of TLL and takes a salary while being here on an expired visa, etc.

Send a packet of that info to the court without commentary and hell have nothing to stand on for asylum.
