Ye its not definitive as you acknowledge, however I would argue that Rose would have less incentive to lie as she was claiming to be 18+ and selling lewd content before speaking to Dman (I'm assuming this, I havent actually double checked the dates but cbf and if Im wrong Im sure one of you will let me know in the nicest way possible). She would have to have been lying about her age ealier. Possible but it feels like there is a lot of incentive to take Dman down and accusing him but omitting any evidence (that you should have on hand if you are telling the truth) while providing less consequential evidence seems like the more suspicious option to me.

For those wondering if there might be legal consequence for Destiny. He prbably did nothing illegal according to the Florida statute 784.049 Sexual cyberharassment

My understanding to fall under Sexual Cyberharassment commonly referred to as "revenge porn" there have to be the following present:
  • It has to be a picture (still or moving). - Audio or sexts don't count under this statute
  • It has to be published to the internet. (made available for the public over electronic means)
  • The person depicted had a reasonable expectation for it to stay private. (Sharing them privately with other individuals explicitly is still considered as staying private)
  • The person depicted has to be identifiable. (It's unclear to me if it has to be identifiable within the material or if it can be another person confirming or naming the involved person)
  • Published with the intent to harm a depicted person.
So unless Destiny has told Rose she can share and publish the videos and pictures, there has probably nothing illegal happened here from his side.

For Solo it would probably be a first degree misdemeanor criminally and in a civil case $10K + reasonable attorney fees and costs. Or if he was able to demonstrate actual damages over $10K, than whatever those damages would be.
But I doubt there will be enough proof to convict Solo beyond a reasonable doubt on anything. And it would damage Destiny even more if it would go to court, especially if the women were to say under oath that they weren't aware and didn't consent of Destiny sharing their porn privately.


All that said I have no legal background and have no Idea how cases like this play out in the real world. Florida might not even be the right jurisdiction, if this would go legal.

Is this how it works for you? If Destiny, a 35 year old man, is messaging someone a day away from turning 18, is that some heinous act, but a day later it's immediately okay? I've been a long time watcher, first time commenter to this forum. so don't hate me because my account is new, i do think Destiny has a huge sex addiction issue that has reached a Weinstein level of... i guess essentially rape. but i don't know if i'd use that word. The cause of the long paragraphs/psychoanalysis is that when someone is a VERY effective psychological abuser (not the buzzword version of the word but the real version) it’s hard to boil down the explanation to a few concise sentences. This is built in by the nature of this type of abuse. If their inexcusable actions can be easily presented and explained, then they aren’t very good at the art of manipulation/psychological abuse. The very core of this type of abuse IS creating tangled webs of explanations, confusion, and a muddling of what’s really going on so the outsider is too lost to even follow the plot.


The effort posters in this thread (Blav, Code Cave, Pepsi) actually work to do the un-tangling. The ironing out. Simplification of what’s happening. It takes a lot of words because a psychological abuser hides behind layers of subtlety/subtext/implications/indirectness, to get away with it.


That poster earlier who said “if he knew Rose was under 18 he would make edgy jokes about it constantly with her”. Are you retarded? That would explicitly implicate him in a crime. Someone well versed in the art of manipulation and psychological abuse remains willfully ignorant in as many situations as possible, on purpose, so he cannot be held liable by his peers.

There's a federal law, 15 U.S. Code § 6851, that let's individuals go after others who leak intimate media about themselves without their consent. This law doesn't care about the intent behind the person leaking the media or the plaintiff's expectation of privacy, only that such materials were leaked without the consent of the person depicted. This isn't criminal law but it gives the women affected a pretty direct legal route to seek damages.
