I think he just lost the appeal, but (and I am not a lawyer), I think how it works with lawsuits for things like harassment and defamation is that the burden of proof for the plaintiff is so strict that if the defendant loses the appeal it pretty much means there is a solid case and the defendant will likely lose if it goes to trial.
