That seems like potentially very effective way to make judge throw book at someone especially a lawyer... Still maybe it plays out being annoying enough just to go for a deal...

At the end of the day, if they actually are looking at significant costs for what is really a basic bitch crime (drug posession), I cant fault them for wanting all this gay nonsense done with as quickly as possible.

Principles matter, but a key principle is doing whats best for the county, and that likely doesn't include dedicating the time to respond to Rekeita making numerous psuedo-plausible claims that require expert witnesess, multiple rounds of lab analysis and a long witness list when the result will be the same: the rich bastard getting a little asspained with no prison time.

Nick is the perfect example of someone who should not be allowed to plead guilty. He thinks he's innocent of everything, and all the wrongdoing was on the part of the government. He's not suffering the consequences of his actions, everything that's happening to him is someone else's fault. Sitting there, and having one side lay out the evidence while he lays out his spin, and having his spin expressly be rejected by 12 of his peers sitting in judgment over him is what this guy needs.

Nick's big lie in that area, so far as it can be determined, is that he can win the case or by challenging all the drug testing in the case.

This gets back to Nick's old (wrong) idea that the state has to prove that he used drugs to convict him of possession. They do not.

All the charges the state has currently brought, including child endangerment, could be made without a single drug test being in evidence. The only area where drug testing would enter into the case would be if the daughter's positive test were entered into evidence and the state sought a higher charge related to the child endangerment aspects of the case.

In a simple possession case and related child endangerment, the only testing that matters is the testing of the substance found during the search of the house. Nothing else matters.

The most likely reason for a plea deal at this point is that Nick is willing to go along with a plea deal which is effectively equal to a sentence in a trial conviction. When Nick talked about the deal with Dax, that seemed like what was being negotiated.

I sincerely hope that whatever deal is negotiated forces Nick to plea guilty to child endangerment. I know he desperately wants that dropped because then he can crow about how the state totally dropped that because they knew it was bullshit and not because that's just how plea deals work. I want him to be saddled with a guilty plea for CE because no matter what cope he comes up with he still plead to it.
